Court Orders PDP, INEC To Recognize Andy Uba by tankoemmanuel(m): 8:31pm On Aug 28, 2013
POLITICAL manoeuvring among aspirants, candidates and political parties towards clinching the Anambra State governorship seat hotted up Wednesday as a Federal High Court in Port Harcourt, Rivers State ordered the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC) to accept Senator Andy Uba as the party’s governorship candidate.

In the All Progressives Grand Alliance (APGA), the rival national chairman of the party, Maxi Okwu, said his decision to field a governorship candidate for the November 16, 2013 governorship election is to ensure that his group is not caught napping after a possible favourable judgment in the suit he filed against INEC at an Abuja High Court.

And in the All Progressives Congress (APC), one of the governorship aspirants, Chief Godwin Ezeemo, has disagreed with a youth movement over the conduct of party primaries to elect who flies the party’s flag come November 16. The party’s primaries was said to have been scheduled to hold on September 1 and 2, 2013.

The Federal High Court presided over by Justice H. A Nganjiwa, yesterday ordered both the PDP and INEC to accept the outcome of the primary election conducted by the Ejike Oguebego-led Anambra State PDP, which declared Uba as the party’s candidate for the election.

The plaintiffs in the suit are: Ejike Oguebego (chairman PDP Anambra State); Chief Gilbert Okoye (Secretary) and Chuks Okoye (legal adviser) while the defendants are the PDP and INEC.

Justice Nganjiwa’s order is predicated on an originating summon filed by the Oguebego-led faction of the PDP. The court also restrained INEC and the PDP from accepting the outcome of the primary election conducted by the Ken Emeakayi-led Anambra State faction of the PDP pending the hearing and determination of the motion for interlocutory injunction and motion to set aside the interim order.

The judge said the court order to recognise Uba as the winner of the PDP primary was based upon an originating summons dated and filed on the 5th of August and after hearing from the J.T.U. Nnodum (SAN)-led counsel for the plaintiffs and PDP’s counsel, Chief Tagbo Ike.

According to him, both defendants should accept the results that emerged from the plaintiffs’ ward and state congresses pending the hearing and determination of the motion on notice for interlocutory injunction or pending the hearing and determination of the motion to set aside the interim order.

The court has adjourned the matter till August 30, 2013.

Okwu, alongside four other officers elected at the April 8, 2013 APGA Convention in Awka, had on August 18, 2013 through their counsel, Oba Maduabuchi, instituted a suit in which they averred that the APGA convention and election on February 10, 2011, in Awka in which Umeh was re-elected national chairman and Shinkafi national secretary alongside other members of the National Working Committee was by voice vote contrary to Article 18(4) of the party’s constitution.

The Court, presided over by Justice A. R. Mohammed, had at its sitting on Tuesday, August 27, 2013 directed that a fresh hearing notice be served on the defendants, before adjourning hearing of the suit to August 29, 2013.

In an interview with The Guardian Wednesday, Okwu said that in the suit against Umeh, Shinkafi and INEC, he is demanding to be recognised as the authentic leader of the party to nominate candidates for the governorship election.

“Consequently, we would field a candidate for the November 16 governorship election in Anambra State,” Okwu said even as he vowed to fight on until he fully recovers the party’s leadership from “illegal occupants”.

Ezeemo of the APC has called for party primary, but the youths under the umbrella of Amalgamation of Anambra Youth Leaders (AAYL) on the other hand are rooting for Senator Chris Ngige as the APC consensus candidate.

Defending their stand, the AAYL has pledged its support for Senator Ngiges’ governorship bid, saying he is best suited for the position. In a statement yesterday in Awka, the group said it has endorsed Ngige as the candidate and urged other aspirants to withdraw and support him.

The group said their assessment was borne out from his outstanding achievements and development programmes, decent brand of leadership as well as his popularity which cuts across the length and breadth of Nigeria.

But Ezeemo, while addressing a rally in Awka yesterday, maintained that there is no consensus candidate in APC for the forthcoming governorship election, saying he wanted primary conducted to select a candidate.

“The APC has not chosen or selected any person as a consensus candidate and will not do so. I say to you with all sense of responsibility that I have not stepped down and will never step down for any person.

“The party national leadership has said there will be a primary to nominate who bears the party flag at the gubernatorial race in Anambra. And until the primary is conducted, no aspirant should arrogate to himself the status of a consensus candidate for the party”.
