Former Governor of Osun State, Prince Olagunsoye Oyinlola, has asked an Abuja Federal High Court to compel the Attorney General of the Federation, Mohammed Adoke, to institute criminal proceedings against MTN Nigeria Communications Limited and its directors over their alleged attempt to suppress evidence.

The suit was filed under the provisions of Order 34 Rules 1 (1) and 3 of the FHC (Civil Procedure) Rules 2009, and section 174 (1) (2) (3) of the 1999 Constitution.

The AGF and MTN Nigeria Communications Limited were listed as the 1st and 2nd respondents in the matter.

In the suit he filed through his counsel, Adebisi Raimi, Oyinlola is asking the court for an order of mandamus compelling the AGF to prosecute the MTN and its directors by instituting and undertaking criminal proceedings against them for attempting to suppress evidence needed by an investigative panel of the National Judicial Council.

In his submissions, Raimi informed the court that his client (Oyinlola) had on March 15, 2012, forwarded a petition to the Minister of Police Affairs and the Inspector-General of Police, complaining about the alleged suppression of evidence, which had an adverse effect on the interests of the former governor.

Raimi further informed the court that the IGP set up a Special Task Force to investigate the petition and on February 8, 2013, a police report in respect of the matter recommended the prosecution of MTN for attempting to suppress evidence.

He added that the case file as well as the said police report, had been transferred by the Force Headquarters to the AGF for necessary legal actions.

However, according to him, the AGF has, since then, failed or neglected to institute criminal proceedings against MTN and its directors.
