Toktee: Let them operate within the constitution and not outside the law thereby trampling on an individual right, what they did was acting the ruling party script, the similar case happened in ekiti and osun,if a judgement like this failed to teach them a lesson, they will nt change.
Let them stop acting like superhuman, the judgement is timely, cos the election is by corner, let them rethnk their action b4 then.

I think your comments are prompted by emotions and interest than the broader perceptive on the functions and duties of DSS with regards to security and preservation based on Intelligence.

Remember, DSS is an Institution of Government and not personal assistant to the ruling party and by Government, I mean Executive, Legislature, Judiciary and the People.

Ngwakwe:

Elrufai is not an opposition to DSS rather a citizen of Nigeria who felt his rights were violated

Learn to debate issues of national importance from citizens perspective rather than party affiliation.

Generally, the citizens are required to protest and lobby the National Assembly to redress and change laws they perceive as anti humanity/anti democracy as opposed to Judges resorting to judicial Activisms thereby taking other organs of the government for a ride.
Now u'r gonna tell us u knw more dan d judge and d bench dat gave d verdict, right?
Was Rufai d only politician in d state then?
On what charge was he arrested?
Was his Fundamental human right infringd upon? Does Rufai constitute a security threat in his hotel room when he was arrested? These r questns Ogar shuld address b4 filing their appeal.
We shuld be happy wit judgemnt like this knowin the height of police brutality in Nja and 4get abt party affiliatn

Ngwakwe:

Don't misunderstand me, I am not against Elrufai in any ramification.

I was trying to reconcile this Court judgement with Laws and Statutes establishing DSS and the implications of this judicial pronouncement on their operational procedures if not appealed.

The courts are there to interprete the laws and statues establishing DSS and not DSS interpreting it itself.
U just don't go around arresting peeps for no reason. Was elrufai the only person in akwa that faithful day? On what basis was he arrested? Why him and not another?
The first phase is gone and DSS rightfully is found wanting for arbitrary arrest for no reason. Let them appeal.

Tell that to the marines.
The moment that wretched woman called Oggar tried to link the opposition to evil boko in line with metuhs line of thought, it was obvious they are for the killer party.
They even went ahead to guard those sharing money during osun election.

I use to think mrs oga is educated untill now. How can she detain a man who was legitimately assigned a duty by his party and call him a suspect. What crime did he comit to warant him been termed a suspect? This impunity has to stop

This shameless Marilyn Ogar should go and park one corner abeg. She and her useless organisation have been turning blind eyes to real issues. Only doing the bidding of their useless Aso Rock Oga.

Ngwakwe: When you have Activists and Social Crusaders on the bench, there abound to be misinterpretation of Institutionalised laws and statutes establishing various Agencies of Government, this indulgence is driven by public opinions at a time rather than the content of laws of the country (constitution and acts of National Assembly).

This Judicial overzealousness (judicial talibanism if you like) is defined as "Legislation from the bench" rather than judicial interpretation of various Legislation and the Constitution of the country as required by law from an organ of the Government.

The Judiciary can reprimand an Agency of Government on operational procedures and not challenging their statutory functions.

The DDS constitutionally have the power of arrest and interrogation and even to detain suspects, but what's this got to do with violating other people's rights, restricting their movements and freedom of association?

The problem here has nothing to do with the ignorant and illiterate woman's interpretation about her agency's constitutional obligations, it's about justification. You don't detain and restrict people for no reason.

Why was he detained and restricted?

Was the man committing or about to commit a crime?

They based their actions on what info or intelligence?

What facts was produced before the judge to justify their action?

Instead of the usual irrelevant, layman one sided summation, these are the relevant and sensible questions you should be asking..

You are not a judge, the case was not litigated in your presence and you have zero access to tendered facts before the judge so curtail the unnecessary attack on the judiciary.
