An Ado Ekiti Magistrate’s Court has vacated an order discharging and acquitting the state chairman of the All Progressives Congress, Chief Jide Awe, and four others of alleged murder.

Others are Faboro John, Aniramu Basiru, Falayi Busuyi and Owonifari Sefiu.

According to a statement by Governor Ayo Fayose’s Special Assistant on Public Communications and New Media, Lere Olayinka, on Wednesday, Chief Magistrate Adesoji Adegboye vacated the order after considering the extant laws, relevant authorities and facts of the case.

The ruling followed a motion ex parte by the counsel for Ekiti Government, Mr. Bunmi Olugbade, seeking an order of the court reversing its earlier decision which discharged and acquitted the accused persons.

Olugbade argued that it was an established principle in law that magistrate courts lacked the jurisdiction to try criminal cases let alone discharge accused persons.

The counsel also contended that by the provision of Section 71 (1) and (3) of the Administration of Criminal Justice Law, Ekiti State, the state Attorney General is empowered to reopen such a criminal case suspended through a notice of discontinuance.

The court had on February 12 discharged and acquitted the APC state chairman and the four others consequent upon a motion of discontinuance filed by the then Attorney General, Wole Fapohunda.

Awe and others were dragged to court for the alleged murder of Mr. Ayo Jeje and Mrs. Juliana Adewumi in Erijiyan Ekiti on March 31, 2013.
