Lagos lawyer and activist, Ebun-
Olu Adegboruwa, has dragged
the Inspector General of Police
(IGP) and the Nigerian Police
Force (NPF) before a Federal
High Court in Lagos seeking an
order stopping the planned
March 28, 2015 nationwide
industrial action by police
officers.

March 28 is the rescheduled date
for the presidential election in the
country.

However, Adegboruwa, in the
suit numbered FHC/L/
CS/340/2015, is claiming that if
the police should down tools and
go on strike, their action will
hinder or frustrate the exercise of
his civic duty to participate in the
elections, since he will become
apprehensive and anxious about
his safety.

The lawyer is also contending
that being categorised as part of
those rendering essential services,
the police cannot go on strike,
since the Police Act in its section
makes it mandatory for the police
to offer protection for life and
property.

The lawyer formulated four
issues for determination, which
included whether it was lawful
for the respondents, their
officers, employees and all
policemen and policewomen
under them, to disengage from,
to withdraw from or to cease to
perform their statutory
obligations of protection of the
life and property of the applicant
and the lives and properties of all
Nigerians.

He said this position is in
consideration of Section 4 of the
Police Act CAP P19, LFN, 2004
and Sections 214 and 215 of the
1999 Constitution (as amended.
He also queried whether the
decision of the respondents, their
officers, employees and all
policemen and policewomen
under them, to cease to perform
their statutory responsibilities of
offering protection for the life
and property of the applicant and
the lives and properties of other
Nigerians, would not jeopardize,
frustrate and undermine his right
of participating in the national
elections in Nigeria scheduled for
the March 28 and April 11,
2015, respectively.

Adegboruwa further urged the
court to determine whether the
decision of respondents, their
officers, employees and all
policemen and policewomen
under them, to disengage from or
decline to perform their statutory
duties, would not endanger his
life and property and the lives
and properties of other citizens of
Nigeria.
