Following several alarm raised by the
country’s major opposition party, the
All Progressive Congress (APC) and
the recent siege allegedly laid by
men of the Nigerian army in front of
the house of a national leader of the
party, Bola Tinubu, a federal High
Court sitting in Lagos has carpeted
the Chief of Army Staff, Lt.-Gen.
Kenneth Minimah.

The Nation reports that the federal
High Court on Thursday restrained the
Chief of Army Staff, from arresting,
detaining, harassing or intimidating
Tinubu.
The order was given by Justice J.T.
Tsoho after hearing a motion ex parte
application dated and filed on March
24, 2015, by the applicant, Bola Tinubu,
through his legal counsel, Femi Falana
(SAN) as well as reading of the affidavit
of urgency in support of the motion ex
parte sworn to by a journalist, Sunday
Dare.
The Chief of Army Staff, his allies,
agents and servants were also
restrained from attempting to stop
Tinubu from participating in the
general elections.
Minimah, his privies, agents and
servants were further restrained from
laying siege to Tinubu’s house, located
at 26, Bourdillon Street, Ikoyi, pending
the determination of a motion on
notice filed against the defendant.

The plaintiff reportedly approached the
court on March 25, 2015, through his
lawyer, Falana to seek the enforcement
of his fundamental human rights.
The plaintiff in his application had
prayed the court for a three days order,
including leave to serve the Originating
Motion on Notice on the respondent at
the Ministry of Defence, Area 10,
Abuja, Federal Capital Territory.
Justice Tsoho granted the three prayers
of the applicant, and adjourned
hearing of the motion on notice in the
matter to March 31, 2015.
It is becoming obvious that the national
leader of the APC, and the former
governor of Lagos State is very
fortunate with law suits.
Tinubu recently also secured victory at
a Lagos State high court, when it
granted the injunction barring, Daar
Communications from disseminating a
documentary titled, “The Lion of
Bourdillon” pending the determination
of “The Motion on Notice.”
