[b] plaintiff in one of the suits challenging the eligibility of the President-elect, Maj. Gen. Muhammadu Buhari (retd.), to contest in the March 28 presidential election is to decide on whether or not to continue pursuing the case after the outcome of the poll.

Buhari, who contested on the platform of the All Progressives Congress, was on April 1 declared winner of the election, defeating the incumbent President Goodluck Jonathan of the Peoples Democratic Party.

Chukwunweike Okafor had filed the suit FHC/ABJ/CS/01/15, challenging Buhari’s eligibility to contest in the election before a Federal High Court in Abuja.

The presiding judge, Justice Adeniyi Ademola, had on March 25, fixed April 22 for hearing in the suit.

The judge had also adjourned two other similar suits in his court till the same date.

Many had observed that the suit and other similar ones challenging Buhari’s eligibility could be more vigorously pursued if Buhari won the election or become an academic exercise if Jonathan was declared the winner of the poll.

Our correspondent on Tuesday inquired from Okafor’s counsel, Chief Mike Ozekhome (SAN), who is leading other Senior Advocates of Nigeria in the legal team, if his client would still be interested in pursuing the case after Buhari won the presidential election.

The question sent as a text message to Ozekhome’s phone had read in part, “Sir, I want to know if your client is interested in the eligibility suit against Buhari given the outcome of the election and President Jonathan’s decision to concede defeat?”

Ozekhome in his reply through a text message said, “I will discuss with my client.”

Apart from the suit by Okafor, there are two other suits before Justice Ademola challenging Buhari’s eligibility to contest in the election.

The plaintiffs in all the three suits want the court to declare Buhari ineligible to contest in the election on the basis of his alleged failure to submit his certificate of academic qualifications along with his Form CF001 to the Independent National Electoral Commission.

If the basis of his eligibility is his certificate, then these guys have been duped by propaganda. The Nigerian Army miraculously found Buhari's WAEC certificate after Jega declared him winner. Lobatan! Case closed grin

All the plots were just to prevent him from contesting then. Now that he is their C in C, its either court no open that day, or make the Judge go on sabbatical. But all in all, those stuffs were just drama that has come to the end after the General's declaration as the winner of the election.
And besides, who go fund the case from now on? Jona don send all of them packing.
it all depend on the judge, its not a must for election matters to be decided before election...buhari's lawyer olanipekun pleads with the judge that it may lead to chaos, and to avert such it was adjourned to douse tension, but nothing changes as the plaintiff had prayed the court to 'direct inec to delete buhari's name if found to have committed perjury

For the case of posterity, the RULE OF LAW has to be allowed in that proceeding. If the military now claims they have his certificate, they should provide it in the law court for all and sundry to see and it should be confirmed by cambridge for validity purpose and cast all dispersions away. And if they NM now have the certificate over night, they should be dragged to the law court and prosecuted for denying having it in the first place. That singular case will be a reference case for all other cases that got to do with forgery and perjury for the rest of Nigeria's existence as a country. Sentiments apart, rule of law should be the watchword here for without the constitution, we are not bound together as a nation and a constitution without the rule of law is NOTHING.

This is not about apc or pdp here.

INEC had no powers to disqualify Buhari - kowei. Buhari had to contest the election on the due date.
