The governorship election petition tribunal in Benue State has dismissed the motion challenging its jurisdiction to entertain the suit brought before it by the Peoples Democratic Party (PDP) governorship candidate in the last general elections, Terhemen Tarzoor.

Ruling on the motion, Chairman of the tribunal, Justice Elizabeth Karatu maintained that the tribunal had the latitude to take appropriate decisions and rulings in order to help and aid the cause of justice.

Counsel to Governor Samuel Ortom, Chief Adeniyi Akintola (SAN), had in his motion described the petition by the PDP as an abuse of court process, while counsel to Tarzoor, Mrs. Joy Adesina (SAN) argued that the motion raised by the respondent was intended to prolong the suit and frustrate the process.

Adesina insisted that all motions raised should be heard alongside the substantive suit.

In her ruling, Justice Karatu relied on Paragraphs 47(1)(2), 18(7)(g) and 12(5) of the First Schedule of the 2014 Electoral Act, as amended and Section 3(1)(2)(3) of the Practice Direction, noting that a lot of time would be saved if all motions raised in the matter were heard alongside the substantive suit.

“It is the position of the tribunal that all preliminary objections and motions in this suit should be heard alongside the substantive matter to save the time of the tribunal.”

In another ruling, read by Justice Katherine Ogunsanya, the tribunal also granted the application for the amendment of the pleadings as brought by the counsel to All Progressives Counsel (APC), and second respondent, Sebastian Hon and thereafter adjourned its sitting to July 7, 2015 for the continuation of the proceedings.

The judiciary must first be independent and fair before this country move forward.


Its a bit ridiculous that teenagers jump at topic with very little to say (even without reading the content) all in the quest to be first to comment. Do they get paid or just to display their joblessness?
