Mulikat Adeola, Ex-reps Leader Loses Again At Appeal Court by chimsimdindu: 10:44pm On Aug 07, 2015
Thirty-seven days after the ‎election petition tribunal dismissed her petition challenging the victory of the Labour Party candidate for the House of Representatives in Ogbomoso North, Ogbomoso South and Oriire, Segun Ogunwuyi, the court of appeal on Friday dismissed the appeal filed by a former Majority leader of the house of representatives, Mulikat Akande-Adeola.

The court of appeal upheld the decision of the tribunal which dismissed Akande-Adeola's petition for failure to apply for pre-hearing session within the time prescribed by the electoral act 2010 (as amended).

While delivering the judgment on Friday in Ibadan, Justice Mudasiru Oniyangi held that the petition was dead on arrival and could not be resurrected, as all the seven issues raised by the appellant were resolved against her‎.

He held further that once a petitioner is served a respondent's reply to the petition, the petitioner's time to apply for pre-hearing session begins to run immediately‎.

‎According to the judge, "The petition in this case is dead on arrival and cannot be resurrected."‎

Akande-Adeola's counsel, Omoniyi Odeyemi, appeared for her while Oladayo Koleola and Abibat Bankole from Afe Babalola & Co. appeared as counsel for Ogunwuyi.

It would be recalled that the three-man tribunal that sat on the petitions arising from the conduct of March 28 Oyo state National and State Assembly elections on June 30 dismissed Akande-Adeola's petition for failure to apply for pre-hearing session within the required seven days.
