Legalizing Sex workers’ Rights

Legalizing the sex workers’ rights has being one of the main agitation of those in the industry. Sex work generally is being referred to as prostitution, but beyond that it also cut across to dancers at the strip clubs, porn models, phone intimacy operators and those who provide sexually related services. Most sex workers hate to be called prostitutes and also do not wish to be branded as criminals, they see the law against sex work, pornography, same sex and all other aspects of sex industry as a violation of their human rights. The National Association of Nigeria Prostitutes (NANP) during the cause of celebrating the victory of General Muhammadu Buhari declared a 3 day free sex services nationwide for all their customers and most importantly pleaded to the newly elected president in their text message through the media to consider legalizing sex workers’ rights for the sex industry. The goals of sex workers’ rights movements all over the world may be different but all still point to the aim to decriminalize and destigmatize sex work and to get fair treatment before cultural forces and the law for all those in the sex industry.

The influence of cultural values and religious beliefs in the formulation of laws cannot be over emphasis as all laws that govern a Nation are being extracted from their moral values and religion. Nearly all the Nigerian cultures are against prostitution and sexually related services, while religion is even a no go area, but the argument is that as a human being, you should have the rights to own your body and to whatever you like with it so far its activities are not infringing on other people’s rights.

We will be looking at the argument for and against the legalization of prostitution as being argued by various human rights activist. Paul Armentano in his article “The Case for Legalized Prostitution,” wrote: “…[T]he most important argument for the legalization of prostitution services is that such prohibitions violate one’s most basic and inherent rights. Prostitution is the voluntary sale (or rental) of a labor service. Individuals own their own bodies and their own labor services and have the absolute right to decide how those labor services should be used. As long as the prostitution transaction is voluntary, there is no justification for governmental interference. Indeed, such interference constitutes an infringement of the privacy and personal liberty of the individuals involved.”

The founder of Sex Workers Outreach project (SWOP) has this to say: “Sex work most DEFINITELY is part of equal rights. The clients of sex workers are primarily men. The workers are all historically oppressed minority groups: Gay and Transgendered men, YOUTH, women and transgendered women. I have always seen sex work as a form of economic justice, and know many people who see it this way as well. On the sex positive side of things, there is a sexual liberation piece that is also worth celebrating for many of the same groups of people. Sex work has opened doors of healing, transformation, freedom and expression for many clients and providers since the beginning of time.”

But on the other hand, legalization of prostitution may have serious bad ripple effects across the nations as there is high tendency for human trafficking activities to increase which involves forcing children into prostitution and furthermore, in the case of Nigeria, there is high tendencies for the rate of ritual killing and kidnapping to increase. Activist like Virada Somswasdi said in a speech at Cornell Law School: It is about the violation of women’s human rights. Prostitution is not about women enjoying rights over their own bodies; on the contrary, it is an expression of men’s control over women’s sexuality. It is the hiring out of one’s body for the purposes of sexual intercourse, abuse and manifestations of undifferentiated male lust. It is about gendered, ethnic, age, racial and class power relations. By no means is it the ‘consent of two adults’, when one party is the buyer and the other the seller, especially when the buying party happens to be socially constructed as ‘the better sex’, ‘the better class’, ‘the more matured’, ‘the power- that- be’, ‘the more cultural polished’ or ‘the fairer skin’ etc.”

Executive Director of the Association Iroko Onlus wrote in October 2004 violence against women article titled “Trafficking for prostitution in Italy” argued that “The argument that regulation of prostitution better protects women in prostitution is deceptive. Prostitution itself is a form of violence against women and a negation of women’s fundamental human rights. Studies have shown that women in prostitution, whether in private apartments, hotel rooms, sex clubs, massage parlors, or in large megacenters of prostitution activities, still experience many forms of violence (Raymond et al., 2002). In a male-dominant culture, prostitution denies equality to women by treating the female body as an instrument of commerce.”

After considering both the arguments for and against sex workers’ rights, do you think the government should still consider legalizing the activities of the sex industry?
