The Illegal Detention Of Mr. Nnamdi Kanu, Another Cup Of Sprewing Dictatorship and concomitant Violent Resistance.



Although I am not a Biafran and do not share in their untenable agitatations, I hold that the alleged continous detention of Nnamdi Kanu ( the Director and host of " Nigeria's Pirate radio, Radio Biafra) in converse to a Courts order makes mockery of the Nigerian state and may be inviting her to a state of lawlessness and anarchy.


It is primary knowledge of law that the right to bail is juiced with both statutory and judicial flavour. Section 35 ( 1) of the 1999 constitution as amended provides inter alia. "Every person shall be entitled to his personal liberty and no persons shall be deprived of such liberty save in the following cases and in accordance with a procedure permitted by law"


While the power to arrest and prosecute alleged law offenders by the Police and other law enforcement agencies is derived from our laws, the same laws outlines procedures for prosecution and frowns greatly at arbitarilly display of power and might by the State and her Agencies over weak and armless citizens. Military Governor of Lagos State V. Ojukwu ( 1986) All NLR 233.


It is required that a person arrested must be taken to Court by the Police within 24 hours or within 48 hours depending on the proximity of the Court, and upon arraignment, the constitutional right to bail of the accused is protected. Alaya V. State (2007) 16 NWLR ( Pt 1f1) 483 at 500, Onyirioha V. IGP ( 2009) 3 NWLR ( Pt. 1128) 342 at 362.


A bail is a security required by a Court for the release of a prisoner as a guarantee that the prisoner would appear in Court at a set date. If the Court has actually granted bail to Nnamdi Kanu and he has met the bail terms, it is then imperative to educate his captors that the purpose of bail pending trial does not translate to acquital and would not inhibit the suspect from coming to Court to answer his charges. If bail means freedom, then it is only a temporary freedom that stops either in the conviction or acqittal of the accused. See Suleman V. COP Plateu State ( 2008) 8 NWLR ( Pt. 1089) 298 at 322.


The alleged continous detention of Mr. Nnamdi Kanu after meeting the bail conditions set out by the Court to say the least is iilegal, undemocratic, dictatorial and highly condemnable. If the accused has desecrated our laws. It is not for the DSS or any other security agency to pronounce him guilty. That is, the secred duty of the Courts. See S.6 of the CFRN 1999 as amended.
Unlike some unsavoury statements flying in the air, Nigeria is not a zoo and not also a military juncta, it is an inherent right of an accused to be prosecuted strito sensu by procedures known to law. In Comptroller of Nigeria Prisons V. Adekanye ( 1999) 10 NWLR ( PT. 623) 4000, Oguntade JCA succinctly put it that " freedom is no doubt, the greatest gift or heritage of men...men are born free with liberty to think what he will, to say what he will and to go where he likes, all in a lawful manner, without let or hindrances from any other persons, private or governmental authorities"

As much as I codemn the alleged hate messages being propagated by Radio Biafra, I wonder if Nnamdi Kanu's offense is heinous than the mass murder and maiming of innocent citizens by the Boko boys. Is Nnamdi Kanu not a saint when compared to the murderous fulani herdsmen ravaging farmlands, raping women and killing farmers in many parts of the Nigeria? Nigerian authorities should remember that the death of Mohammad Yusuf never ended the Boko Haram insurgency. The Constitution is Supreme above all sentiments and should be treated same.
