Pastor Tunde Bakare of the Latter Rain Assembly has risen in defence of the 27 soldiers of the Nigeria Army jailed for life in April.
He described as injustice the fate that befell the soldiers who were jailed for life for mutiny by a court martial presided over by Brigadier General Baka. He slammed president Umaru Yar’Adua and army chiefs for the fate of the soldiers.

Preaching on the topic: The Nigerian Nation, Quo Vadis (What Next?) yesterday, Pastor Bakare warned that all those who perpetrated the injustice against the soldiers, be he the president (Yar’Adua), the army chiefs, etc. will not know peace until they reverse the judgement. He said this was the only way they could avoid God’s wrath. He said the soldiers were protesting legitimately against being cheated by their superior who seized their peace-keeping allowance and wondered why they should be accused of mutiny and punished unjustly.

He said he was speaking for the voiceless, adding that a nation that abhors justice is doomed.

Pastor Bakare reiterated that those who jailed the soldiers will not know peace until the victims were released and the judgement brought against them was quashed.

The counsel to the soldiers, Mr. Femi Falana, had petitioned the Chief of Army Staff, insisting that the soldiers were jailed in error.

Falana argued that the accused persons were charged with the offence of mutiny, contrary to section 52(2) of the Armed Forces Act (Cap A20) LFN 2004.

He alleged bias against the president of the Court Martial, Brigadier-General Baka.

According to Falana; “Before the arraignment of the accused soldiers, they objected to the constitution of the Court Martial based on the statement made by Gen. Baka in Sokoto, on 17 September, 2008, to the effect that he would deal with the accused for their act of indiscipline. The defence requested him to withdraw from the court martial pursuant to section103 of the Armed Forces Act.

“Instead of withdrawing to allow other members of the court to consider the objection, the president of the court took part in the consideration of the objection, contrary to section 137 of the Armed Forces Act. Not unexpectedly, the objection was dismissed by the court martial without any legal justification whatsoever.”
Falana also said the prosecution failed to prove its case beyond reasonable doubt, and that the entire case was based on suspicion which cannot be ground for conviction under the nation’s laws.
