It should not. But you see, the practise is different.
For examplr;
The US walked out of it yet it still is the biggest contributor.

Sudan too, is not a signatory, but there is a Warrant of arrest against Bashir.

You may be right about ISIS though. The ICC statute does not foresee non- conventional armies and states. Terrorism needs either a complete overhaul of the ICC Statute or a whole different convention dedicated to such scenarios.
