Senator Bukola Saraki and other senators have arrived the court room around 9:55 am. He immediately went to greet members of his legal team led by Kanu Agabi.

At 10:28am, Justice Umar Danladi finally walked in with the other members of the tribunal. Proceedings has commenced with the Tribunal Clerk calling the case.

The Senate President is again seated inside the dock and as usual, he is not looking comfortable inside at all.

Saraki’s lawyer has also announced that the number of the lawyers to defend the Senate President may have increased to 80 as indicated by his lead counsel at the commencement of the trial.

“We shall win as there are 80 of us on this side,” Kanu Agabi said as he started announcing the the names of the other lawyers with him.

The Chairman of the Tribunal and others in court burst into laughter as he said this. He then began to reel off the long list of names of lawyers with him.

Entertainers. My own is that the national embarrassment of a padded budget must not be passed. Saraki is man enough to do time in jail if found guilty.

From 30, senators with Saraki at CCT shrink to 18.

Senate President Bukola Saraki has arrived at the Code of Conduct Tribunal (CCT) where his trial for alleged false declaration of assets continues.

He arrived at 9:55am in company of at least 18 senators.

The number of senators who accompanied him on Friday was less than the 30 who accompanied him to the tribunal last week.

Saraki wore a flowing milk-coloured “Agbada”, and sat gently in the second row of benches reserved for senators.

Some of the senators present are Abdullahi Sabi, senate spokesman; Sam Anyanwu, Stella Oduah, Ben Murray-Bruce, Tayo Alasoadura and Andy Uba.

This is the fifth time the senate president will appear at the CCT.

The first time was on September 22, 2015 after the tribunal had issued a bench warrant for his arrest. He was accompanied to the tribunal by at least 50 senators on that day.

On the same day, he was docked, but he pleaded not guilty to 13 counts of false declaration of assets brought against him by the Code of Conduct Bureau (CCB).

The second time was on October 21, 2015 when he was accompanied by at least 81 senators to the tribunal.

And the third time was on November 5, 2015, when his lawyers, Joseph Daodu and Mahmud Magaji, withdrew from the case in protest of the decision of the tribunal to continue the matter despite an appeal against the constitution and jurisdiction of the tribunal at the supreme court.

The senate president had gone the whole hog to challenge his trial at the CCT, but he failed at every turn.

On February 5, the apex court dismissed the appeal to stop his trial paving the way for the continuation of the case at the CCT.

The CCT had earlier fixed March 10 for trial, but it shifted to March 11 at the instance of Kanu Agabi (SAN) Saraki’s new lawyer. On March 11, Saraki’s lawyer filed an application challenging the jurisdiction of the tribunal. The application will be heard on Friday.

When will the citizens begin to feel the positive impact of govt. On this corruption high sound, I will shout hurray should this govt recover one trillion only in the next 3yrs.

Anyway, nigerians are waiting till 31st of this month for detail of recovery and those culpable as promised by president Buhari during the media chat.

If my Uncle ( a lawyer ) could defend a Murderer ( we all know he did it because he confessed at home), then nothing is impossible again!!

Some Lawyers are pure lairs, devilish agents and people of no conscience!!

Even the mother of the deceased was crying in court! But the rich man bought his way through!!

Ricky Tarfa, the lawyer did the same stunt few weeks ago with scores of lawyers, where is his case now...still in court with more incriminating revelations.

Saraki should learn to be humble, whatever happens after this episode, his political career has been greatly affected.

Senate President Bukola Saraki, won the first part of his battle to stop his trial at the Code of Conduct Tribunal, by letting tribunal hear his motion over jurisdiction.

Government lawyer, Rotimi Jacobs told the Tribunal he has been served with defendants motion dated 4 March, 2015.

But he argued that going by sections 220, 221 and 396 of the Administration of Criminal Justice Act, the motion cannot be moved before beginning of hearing of the substantive case.

“The only thing the court can do now is to proceed to trial. I want Your Lordship to determine the issue now,” Jacobs said. He further explained that the of ACJA stipulated that technical objections cannot be raised during trial.

He added section 396 (2) said after a plea has been taken, the defendant can raise any objection which can only be considered alongside the substantive trial.

According to him, the defendant is challenging the validity of the charges by saying the Attorney General did not have power to filed charges against him or that he was not informed before the charges were filed against him.

Jacobs urged the Tribunal to enforce the ACJA to ensure that justice is done according to the law. Jacob said the court should allow the prosecution to call his witness.

Kanu Agabi, for Saraki said the defence is happy to be in court and the opportunity to defend him.

He argued that motion is part of administration of justice and the Tribunal should hear it.

He reminded the Tribunal Chairman that he ruled last Friday that the motion would be argued today.

The defence counsel said the motion is challenging the juridisction of the tribunal to hear the case.

Justice Umar however ruled that he is ready to hear the motion as anything done by the Tribunal without determination of the issue of juridisction will be nullity.

Agabi is about to move the motion now.

Nigeria is just a jungle... Imagine eighty lawyers (80) going for a single case,that means they are all idling away all this while....I was told that the legal representation fee of a SAN is in the millions...so millions are going down the drain here today?.

Chief Kanu Agabi, Lead lawyer for Senate President, Bukola Saraki demands his client’s discharge and acquittal by the Code of Conduct Tribunal, the way it was done for Asiwaju Bola Ahmed Tinubu, five years ago.

Agabi told the CCT panel that the Code of Conduct Bureau case was flawed as Saraki was not invited, when it had an issue over his asset declaration.

Agabi said his team is not raising any of the issue that has been determined by the Supreme Court.

He said the issue being raised in the fresh application is that failure of the CCB to act 13 years after the defendant filed his forms is fatal to its case.

”If for any reason, the defendant has committed any offence he should be informed. The defendant has not been given any opportunity to defend himself against the charges. The AGF has no jurisdiction to prefer the charges and therefore the Tribunal has no jurisdiction to hear it.

“Under our constitution, the moment a man comes under justifiable suspicion, he must be informed promptly of the reasons for the suspicion”, said Agabi.

He said failure to inform Saraki was against the principle of fair trial. He said failure of duty on the part of the CCB for 13 years operates to the peril of the Bureau.

He said there is no document to indicate that any member of public has complained or that the CCB has conducted any research to implicate the the defendant.

He however agreed that there are aspects of the charges against Saraki that can be prosecuted elsewhere.

“The result of the investigation by Bureau is expected to be presented to Your Lordship, where is it?” Where is the reference? We don’t have it, you can struck it out and let them start afresh.

“He has not been invited, he should be invited like Tinubu. He is the Senate President of this country. He has not been invited, it is not discriminatory. My Lord, the reason you said you allow Tinubu to go home was that ten other governors were invited, but he was not invited, the defendant is a former governor. ”

He then asked the Chairman of the Tribunal to strike out the charges.
