*Acting CJN may face adverse ‘security report’

ABUJA—Pressure has continued to mount on President Muhammadu Buhari to forward the name of the Acting Chief Justice of Nigeria, CJN, Justice Walter Onnoghen, to the National Assembly to be confirmed as the substantive CJN before February 10.


Onnoghen, who is presently the most senior Justice of the Supreme Court, is the first Southern jurist to qualify for the judiciary top-job in about 30 years.


However, his confirmation as the substantive CJN seems to hang in the balance owing to alleged moves by “some highly-placed forces,” to sideline him to enable a northern jurist to take over.


A top source at the apex court told Vanguard last night that “conspiracy” to push Onnoghen out upon expiration of his acting tenure has further thickened.
According to the source who craved anonymity, “Emergence of Onnoghen as the substantive CJN is now in the hands of God. I can authoritatively tell you that the plan is to frustrate his validation by the National Assembly until February 11.


“As I am talking to you, there is fear that those bent on ensuring that a Southerner does not head the judiciary at this point in time, especially during the tenure of President Buhari, may have concocted adverse security report against Justice Onnoghen.



“Their plan is to submit the security report, which will raise sundry corruption allegations against Justice Onnoghen to the Senate, few days to the expiration of the three months acting period.”


Specifically, going by section 321(5) of the 1999 Constitution, Onnoghen will vacate his position as the acting head of the judiciary in 33 days time.


The section provides that the appointment “shall cease to have effect after the expiration of three months from the date of such appointment, and the President shall not re-appoint a person whose appointment has lapsed.”


Buhari had on November 10, 2016, okayed Onnoghen to head the judiciary in acting capacity following retirement of the immediate past CJN, Justice Mahmud Mohammed.


Already, a Lagos based lawyer, Chief Malcolm Omirhobo, has gone to court to challenge President Buhari’s delay in forwarding Onnoghen’s name to the National Assembly for confirmation.


Omirhobo is praying the Federal High Court sitting in Abuja, to compel President Buhari to immediately forward Onnoghen’s to the Senate.


Remarkably, the next in rank to Justice Onnoghen is a northerner, Justice Ibrahim Muhammad, who hails from Bauchi State.


Justice Ayo Irikefe, who held sway as the CJN in 1985, was the last Southerner that headed the apex court.
After him, subsequent occupants of the position came from the North.


Justice Mohammed Bello took over from Irikefe from 1987 to1995, Justice Muhammadu Uwais served between 1995 and 2006; Justice Alfa Belgore (2006-2007), Justice Idris Kutigi (2007-2009), Justice Aloysius Katsina-Alu (2009-2011), Justice Aloma Mukhtar (2012-2014) and Justice Mahmud Mohammed, who served from 2014 till November 10, 2016.


Meanwhile, among those asking President Buhari to forward Onnoghen’s name for confirmation include retired Judges and Senior Advocates of Nigeria.
A retired Justice of the Supreme Court, Olufunlola Adekeye had earlier stressed that non- confirmation of Onnoghen as the substantive CJN was capable of truncating reforms in the judicial sector.

Anybody that tamper with Onnoghen confirmation as CJN b it Buhari or not will never know peace.This is d first time we will have somebody frm this part of d Niger climb to such position. May b this will b d litmus test whether we will remain one or not. I pray Buhari act right otherwise we will bring this country down. Nonsense.

I hope this not a plan to sideline southerners because any move to sideline Justice Onnoghen will be resisted vehemently. Buhari we urge you to make the right decision for the interest of the nation.

The pendency of the suit does not stop the president from sending his name to the Senate or his confirmation by d Senate. There is no order of court to maintain status quo until the suit is determined. All that will happen is that once the the president and Senate do their jobs, the case will be struck out as having been overtaken by events. It will be necessary though for the court to give d case an accelerated hearing due to d sensitivity of time.

My prayer is that the judiciary should not be politicised because it is the hope of the common man. The independent of the judiciary cannot be overemphasize in a democratic society .

Buhari has just destroyed the same judiciary he is trying to sanitize. If Walter isn't made the chief justice by Feb any other person that would be made would dance to the tunes of some evil powerful forces. Smh

I don't get. Why is it difficult for the president to confirm the Hon. Justice as CJN? Is it 'cos he's from the south of Nigeria?

All these are calculations towards 2019. From experience, Onnoghen is an independent minded judge who has always been known for giving dissenting judgements. He gave a judgment in favour of Buhari some years back against the ruling party and has a history of doing such.

Now, Buhari's caucus know that they can't win 2019 elections fair and square, hence they are trying to use underhand tactics to get the judiciary on lock down. Unfortunately for them, Onnoghen as the CJN would sit as the Presiding Judge over the Presidential elections and they know he can't be cowed. That exactly is why they are looking for a more malleable Judge they can influence.

Buhari is not ignorant of what Mamman Daura, Abba Kyari, Babachir David Lawal and co are doing as he is tacitly in support. It's a game of good cop/bad cop. He's acting all innocent for the others to look guilty, but he's in the plots being woven around him.

This goes to show this country judicial system has been skewed in Northern favour for decades.
Whenever I hear how the Northern guys raise hell with southern jobs, It just goes to confirm the inherent hypocrisy package that comes with being Nigerian.

President Buhari misses the point! He refuses to confirm Onoghen as Chief Justice of Nigeria yet asks Jammeh to confirm Barrow as President! Since 1987, the most senior Justice of the Supreme Court automatically became Chief Justice of Nigeria. After 30 years of Northern Chief Justices of Nigeria, it became the turn of a minority Southerner and all of a sudden President Buhari refuses to nominate him as substantive CJN. Is that any different from what Jammeh did in The Gambia?
