Two Senior Advocates of Nigeria (SANs) Yusuf Alli and Sebastine Hon yesterday said President Muhammadu Buhari complied with the Constitution by notifying the National Assembly of the extension of his vacation for health reasons.

They said since he handed over to Vice President Yemi Osinbajo who will continue to act as President, there was no vacuum, which the Constitution abhors.

Alli said: “We should all just be praying for his recovery. May God shield him so that he can get back to his duty-post.

“He has transmitted a letter to the National Assembly. That’s what the Constitution says he should do. And he has done that.”

On Buhari not stating when he will return, Alli said: “What is important is that he has transmitted a letter saying that he would be away.

“This means by extension that the Acting President continues in office, so there is no vacuum. What the Constitution wants to prevent is a situation where there is a vacuum. Somebody was acting for him and will continue to act.”

Hon, a constitutional lawyer, said Buhari means well for Nigeria by handing over to the Vice President before traveling.

He said the Acting President has full powers of a President, so there was no vacuum.

Hon said: “It is still within his constitutionally allowed time to be absent. Anybody can be sick, so let’s not over blow this thing. I would want everybody to pray for him and to wish him well.

“The Vice President is the Acting President. He has all the powers of a sitting President as it were, in the absence of the President.

“Buhari has done well by handing over to the Vice President. Some other people don’t do that. Some governors don’t hand over to their deputies when they travel.

“So, to hand over to the Vice President shows he means well for the country.”


Elder statesman and retired Federal Permanent secretary Chief Deji Fasuan, said it is a matter of regret that the president could not return yesterday as expected.

He added: “since we are all human beings, we are subjected to vicissitude of life including problem with body chemistry. We should continue to pray for him and to wish him well s that he get well quickly and rejoin us.

“This is one president, a Nigerian who loves this country dearly and who is desirous of cleaning it up. I’m sure all men of goodwill will wish him well.”

But a former Minister of Aviation Femi Fani Kayode in a tweeted last night: “Buhari has finally acknowledged that he is sick and has extended his stay abroad indefinitely. It is now clear that Nigeria is in trouble.”

What's the big deal in the Presidency allowing Nigerians to know exactly the current status of PMB's health. Scheduled health test should have a timeline and hence they should be in a position to know when exactly these tests will be concluded and hence when he will be back at work.
Information are kept out of the public, then we have right to what to believe and say.

Technically theres a vacuum. Osinbade cant do jack cos his hands are tied. He cant effect any real changes like a functional President can do. Infact, right now, Kyari and Babachir are the ones ruling. Hes still a dummy President as far as we know.

Well, what is paining me personally is the fact that he's in a foreign land treating himself, spending Nigeria money in abroad when he could have stayed back in the country and make use of the nation's health services since he's the one who said Nigerians shouldn't patronize any foreign goods or services. Why can't he do or carry out what he's asking other Nigerians to do? What is wrong with equipping our hospitals with necessary facilities that will meet up with what he has gone abroad to patronize.
If he can't patronize Nigeria goods or services, why is he forcing other Nigerians to do same, isn't that hypocrisy? And to say that he and his cabinet members do not see anything wrong with their hypocritical attitude tells a lot about the type of leaders they are.

Government of "do as I say, do not do as I do"
Government of so so talk, opposite action.
Government of deceit.
Government of hypocrisy!
Government of suffering and hardship!

Full recovery in old age is less likely. The fact has already been established, he's no longer fit to preside.


The senate should move to secure the nation. An impeachment should be initiated on the grounds of ill health. The acting president should be sworn in.

It is common sense to know that there is no Vacuum.

There is an acting President and is name is Osinbajo.

Buhari has done the right thing unlike PDP during Yaradua's saga.

He wrote to the house and transferred power officially to his VP.

Anybody can be sick. It is not a big deal.

Nothing has changed.....
There's no vacuum as Buhari communicated the house before leaving, unlike the Yar'Adua episode. It is now to see how smart Osinbajo is. If he likes, he should allow dem Kyari and Dara steal the show from him.

He should've stated he was going for medical trip instead of lying about taking a vacation. He should get well soon, return and then resign and enjoy the rest of his old age at home

I do not think there is anywhere in the world that a 'worker' or 'employee' can request an indefinite extension of leave even on medical grounds. There ought to be a clearly stated date of return. Again, it is unheard of that leave is extended on medical grounds without a detailed medical report. In fact, it is that report that serves as basis for which an extension can be requested and granted after necessary considerations.

We do not have such a situation here rather just a flimsy open-ended letter. Beyond handing over to the VP, it is dangerous for any office to be run in acting capacity particularly one as sensitive as the Office of the President for an indefinite length of time. The 'acting person' is severely limited even though, on the face of it, he is said to have all the substantive powers of that office. He is unable to make any decisive changes or reviews both of policy and appointments for fear of 'offending his boss'.

Long story short, a definite date of return needs to be fixed and communicated to the Senate. When he is unable to 'return' at d expiration of such date and upon independent medical advice, he is to be declared medically incapable of occupying and running d office and the Acting President sworn in as substantive president. Whoever occupies that or any other office needs to work with trusted hands that he can reasonably vouch for.

If the gentleman cant make it back to the office, Osinbajo should be declared substantive preside t right away. The uncertainty and tension this whole drama is creating isnt healthy for our nation, both politically and economically.

Let the president's handlers do the right thing by telling us the truth about his condition, or do they have to empty the nation's treasury first? I know everyone would be looking to steal as much as posible for themselves right now. angry

Technically there is a vacuum,and the war against corruption will slow down. That's if he's really fighting corruption. Osinbajo doesn't have the guts to fight it.

What he smartly did before leaving for his trip was to trasmit a letter to the senate that he was going on a vacation and rather than leave the seat vacuum. If he had gone without transmitting a letter to the National Assembly and the situation turned out as it is now, it would have generated great controversy. But better still, he has to specify when he will be coming back. The VP can not be acting as the acting president for so long considering the present state of our government.
