The court ruled that Olajide Enilari's death was a gross violation of his right to life

The Federal High Court in Lagos has ordered the Nigeria army to pay a damage of N85.5 million for assaulting and killing a civilian, Olajide Enilari.

The court in its judgement said the killing of Enilari, who was a flour merchant was wrong and unlawful.

Justice I. N Buba who presided over the matter ruled that the Nigerian army pay N85.5 million to the family of the deceased.

He also ruled that the assault which led to Enilari's death was a gross violation of his right to life.

Justice Buba ordered the defendants - the chief of army staff, the chief of naval staff, the attorney general of the federation and three others - to pay N50 million as aggravated damages.

Buba also ordered the payment of N295,000 as damages to cover the deceased funeral expenses.

He also granted the plaintiffs N35 million for loss of pain caused them by the brutal assault on Enilari and awarded N250,000 in favour of the plaintiff.

All the damages awarded by the court against respondents totaled N85,545 000.

Enilari was brutalized by some officers of the Nigerian army on January 27, 2009, along Airways Junction in Apapa, Lagos.

He was said to have later died on January 29, from head injuries sustained during the assault.

Testimonies and evidence made available to the court found no merit in the defence case.

In his reaction, Chinelo Chinweze, the senior programme officer at Access to Justice, the civil society organization who filed the suit on behalf of Enilari and his family said the standard secured by the court's judgment would help address the discouragement faced by victims of human rights abuses.

Chinweze said: “We need to reform our judicial procedures to reduce the time taken to meet basic justice needs and deliver needed services."
