I decided to put this here cos am very sure most of you barking here are aware of this but your hatred for Buhari has beclouded your sense of reasoning.

“Secondly, there’s already a court judgement regarding the powers of the National Assembly when it comes to the issue of guidelines and timetable for elections. This is a complete deviation from what the court said.

Is that not contradictory? Guidelines and timetable are laws regarding the electoral process. They are procedural laws.
The Nigerian Constitution is poorly written sha.

If you think PMB has time over election reordering then you need to wake up from you slumber. If the senate like let them bring election tomorrow without campaign PMB will still win.

The problem about the reordering of election is between the senators and the reps. Many of them attained the seat with Sai Baba popularity, these are the people that are against the reordering.
The people championing it are the likes of Dino Melaye, Shehu Sani knowing fully if they did not take a bow from their respective governors they may not be return to the senate.

As for PMB, Baba is unshakable.

On a serious note, the NASS can make laws with respect to election matters. If the president vetos it then they can veto back with a 2/3rd vote.

Only 35 members were actually part of the amendment lolzzzzzzz........so.where is the basis?

4. (1) The legislative powers of the Federal Republic of Nigeria shall be vested in a National Assembly for the Federation, which shall consist of a Senate and a House of Representatives.
(2) The National Assembly shall have power to make laws for the peace, order and good government of the Federation or any part thereof with respect to any matter included in the Exclusive Legislative List set out in Part I of the Second Schedule to this Constitution.

Item 22. Election to the offices of President and Vice-President or Governor and Deputy Governor and any other office to which a person may be elected under this Constitution, excluding election to a local government council or any office in such council.

I disagree with the decision because the Constitution is pretty clear on this issue IMO. Truly the power to conduct elections and schedule the timetable was delegated to INEC (an executive agency), however if the NASS disagrees with INEC, they have a right to present new law as a bill to the president for signature or veto. If PMB vetoes, then they can override it by a 2/3 vote.

Everyone knows that except the illiterates, even my unborn child in the womb knows that the Court has exceeded its judicial mandate.


The Electoral Act has always been altered or more appropriately, amended by the National Assembly depending on how the majority sees it. In 1999, Presidential election came last and nobody made noise about it so why the sudden and loud noise on this one?
all I can see is that there are 3 tiers if government, and am confused how they share their power. Or who controls who.

The legislature can not dictate how inec does its work ! Can the senate tell the police to stop an investigation ? No they can’t - why - the police is constitutionally empowered to do their duty , same as inec !

APC and the buhari lead administration has turn the judiciary to a joke. How can a court stop the national assembly from carrying out it's constitutional mandate given to it by the people?

The court should have used its judges to affirm the appointments of those the Senate refuses to confirm as well if they think they have more powers than the legislative arm of government.

If I were the senate I'll outrightly discard this junk injunction and go ahead with the peoples mandate. After all the buhari lead administration is known for boldly disregarding court orders as seen in the cases of dasuki, KANU, el zakky and other citizens who's rights buhari has trampled upon.

Buhari chooses what court order to obey and disregards the one that doesn't favour him. This same man has the mind to run to the courts he has so far disregarded. Buhari is a joker! The senate must go on.


The judiciary can technically put a clog in the activities of the NASS if they contradicts the constitution in their so called mandate. It has happened countless times in the past.

I can even recall that GEJ vetoed the last constitutional amendments and proceeded to sue the 7th NASS before the supreme court. Till date, that purported amendments never saw the light of the day. Mark this, same will happen to this bill.

You are funny sha. How can NASS enforce a law without the judiciary and Executive?? They are just sitting ducks without the powers of the two of them, and most especially that of the judiciary.

For example, if the judiciary rules that a particular section of the electoral law is null and void on account of its contradiction with some portions of the constitution, all INEC needs to do is to ignore the law as ordered by the judiciary.

Now, Oga how will your 'powerful' NASS enforce a contrary opinion to that of the judiciary? There is no way they can go about it, it's an exercise in futility.

NASS can make laws, but any law so made can be made inoperable by the pronouncement of the Judiciary. It is not rocket science.

oga,dont be clever by half.you cannot alter constitutional provisions by mere amendment of acts/bills.you do so through amending the constitution.let nass follow that path.from what cashkid posted,the courts have judged similar issues in inec's favour so it will still follow suit.

Delivering ruling on an oral application by Chief Wole Olanipekun (SAN), lawyer to the plaintiff, Accord Party, Justice Mohammed held that the restraining order was made to preserve the substance of the main suit.
President Muhammadu Buhari had, on Tuesday, informed the National Assembly that he had withheld his assent to the bill which was earlier passed by both chambers of the National Assembly.
There have been threats by some legislators that the National Assembly would evoke its powers under Section 58 (5) of the Constitution to override the President ’ s withholding of assent by two- thirds majority votes of both chambers .
The oral application by Olanipekun for a “preservative order” was opposed by the counsel representing the National Assembly, Chinelo Ogbozor, during Wednesday ’ s proceedings.
The Attorney- General of the Federation , the second defendant to the suit, was not represented by a counsel.
But INEC, the third respondent, was represented by its lawyer , Mr. Taminu Inuwa, who said he had no objection to the application.
Ruling , the judge held that the National Assembly was not likely to suffer any prejudice if it was restrained from going ahead with the amendment processes before the next hearing date .
He added that on the other hand, if no restraining order was issued and the National Assembly went ahead to exercise its powers under Section 58 (5) of the Constitution by overriding the President ’ s withholding of assent, the essence of the whole suit would have been defeated .
The judge therefore ordered all parties to maintain the “ status quo . ”
He fixed Tuesday for the hearing of the motion for the interlocutory injunction, the same order which was granted during the Wednesday ’s proceedings but would likely last till the final determination of the suit if the application succeeds .
The Accord Party is , by its suit, challenging the constitutionality of the ongoing amendment of the Electoral Act .

It seems Nigerian courts do not know that it's not all suits they can entertain. How can you stop the national assembly from doing their constitutional duty of law-making. And smartly, APC is using a very unknown party to run this errand. Maybe very soon a stranger will go to court to prevent another person from going ahead to wed and the court will give an order to suspend the wedding until the suit has been determined.
