The state high court sitting in OWERRI today set aside the impeachment of Prince Eze Madumere as the deputy Governor of Imo state.

There is jubilation within the premises of the Owerri High Court as Justice Benjamin Iheaka declared the impeachment of the Deputy Governor of Imo state, Eze Madumere, invalid and of no legal effect.

The presiding judge Hon. Justice Benjamin Iheka says both the Chief Judge and the Imo State House of assembly did not follow due process in the impeaching the deputy Governor.

In reading the judgment which lasted for three hours, the justice flayed the Chief Judge of the state, Paschal Nnadi and the Attorney General of the state, Militus Nlemadim for not adhering to the provisions of section 188(5) of the 1999 constitution as amended in the impeachment of Madumere on July 31, 2018.

According to the judge both the state Chief Judge and the Imo state House of assembly did not comply with the seven days’ notice as stipulated by the 1999 constitution

The presiding judge says section 188 sub sections 5 of the 1999 constitution says within 7 days of moving the motion, the Chief Judge shall appoint 7 man panel to look into the impeachment raised by the lawmakers instead the CJ used 9 days in constituting the panel which according to him is not in tandem with the law.
