Onnoghen: Falana Accuses NBA Of Playing Double Standard by odiks: 1:43pm On Jan 29, 2019
Rights activist, Femi Falana (SAN) has accused the Nigerian Bar Association (NBA) of playing double standard by taking a position to support the suspended Chief Justice of Nigeria (CJN), Justice Walter Onnoghen.

Falana argued that it was wrong for the NBA that called for the suspension of judges who were arrested by security agents in 2016 to now turn around to fault the suspension of a CJN, against who pm a charge is pending.

Falana, who was at the High Court of the Federal Capital Territory (FCT) to attend to a case, in defiance of the NBA’s directive that lawyers boycott court, said the directive was ignored by many lawyers who turned up in court today.

He said while he faulted the Executive’s decision to suspend the CJN on an ex-parte order, he thinks Onnoghen should resign.

No double standard Mr.hypocritical Righteous man. Can Falana tell Nigerians he is not convinced that the Buhari govt is not bias in their approach in the CJN case because of the obvious fear of the impending disastrous fallout for the APC in the upcoming election

Onneghen may be guilty or otherwise but why did the government jumped the gun with supersonic alacrity in the handling of this CJN case with a judicial speed never seen in histroy? No room for the man to even argue out his case?

And why must the FG obtain a fraudulent injunction from an inferior court of the CCT status to counter a judgement from the FHC/court of appeal that are of higher jurisdiction?

Who in the APC regime that have been accused & indicted of corruption resigned let alone faced prosecution, conviction & punishment.Kemi Adeosun , Lawal Babachir, Abba Kyari, Mikanti Baru, Abdurasheed Maina, Aisha Buhari #2.5B queried "gift donations" have all been well shielded to escape justice.

Even the CCT chair-Danladi Umar still have a corruption case on his neck yet he is adjucating on justice. What an irony.

Meanwhile,Adebayo Shittu, Obono-Obla etc are still serving the anti-corruption fighting govt.OUK is receiving Buhari today in Aba despite a FHC warrant for his arrest while his corruption case have been postpone indefinitively.

We can see, therefore, that President Buhari’s anti-corruption fervour is merely self-serving. He regards only his political opponents as having the copyright on corruption. By this token, every allegation of corruption leveled against his friends and financiers must be “baseless.” https://opinion.premiumtimesng.com/2018/10/23/president-buhari-is-not-against-corruption-by-femi-aribisala/

President Buhari currently faces serious allegations, which include staging show trials of opponents of a regime that is accused of corruption and graft, while simultaneously shielding his own party members and inner circle.

So does it not ring a bell to Falana that this is simply a selective vendetta by the government?

"....However, in view of President Buhari's belated fidelity in the rule of law the federal government should comply with all valid and subsisting orders of competent municipal and regional courts made against the federal government.

President Buhari should not be permitted to choose and pick orders of courts to obey."

Lawyers' own protest should be by way of lawsuit in court of law, using the instrumentality of law, not by boycott like labour union or civil society group. NBA is a professional body, not a Labour Union.

The Senate seem to recognize this fact more than our learned gentlemen and have chosen the more noble path of approaching the Supreme Court to seek legal redress.

The NBA should not forget that there are members of the Association whose view and standpoint on the Onnoghen saga are on the side of the FG and are arguing differently. These set of people also deserve to act along their own point of view. If the battle gets to Court, it's still the bonafide members of the Bar that would argue on the part of the Executive arm of Government.

There is no amount of protest or boycott that would change the status quo, the whole saga is a matter to be determined judicially in the long run.

If the FG refuse to be moved to shift ground after the two-day courts boycott, is NBA Exco going to direct their members to proceed on indefinite boycott of courts? Obviously, the effect would be more against the Bar than it would be against the Government. I'm sure that by that time, NBA would witness the greatest disobedience and the stiffest opposition from their own members nation-wide! This is because it would touch on their personal economic survival more than it does professional.

NBA should quickly recognize this fact, this battle can only be won in the court of law with legal fireworks than on the streets of protest and court boycott. How do you challenge the alleged Constitution violation by staying away from courts saddled with interpretation of Constitution? NBA should kindly toe the path of the Senate by approaching the court of law.

A country where court orders ain't obeyed is called a Joke.

Looting is different from forgetting to declare assets.

Falana speaks cowardly sometimes.
One minute he condemns the suspension of the CJN, the next minute he’s supports the FG unlawful actions.

Onnoghen started by being a corrupt judge, failed to declare his assets as required by law and living above his means. That's bad for him and for PDP.

Buhari and his men desperately need to win reelection and Onnoghen is CJN and a PDP judge (sorry I mean South southerner).

That's too ugly for Buhari's health and ambition. Buhari invokes his power as president and suspends him as a strategy to secure the judiciary during post election litigations.

I don't know why jobless e-warriors are fighting each other because: Onnoghen is a corrupt Judge of the PDP winged by a desperate president.

Meanwhile the supposed agitation by NBA has been widely politicized as usual with everyother issue of national interest so it will die a natural death.
RESULT: the suffering of the masses continue until they #scrapPDP&APC

Falana should just shut up already. It is not the allegation or accusations against the CJN that the Nigerian Bar Association is protesting. They are protesting the process of suspending CJN which is an abberation and violation of the constitution.

There is an appropriate procedure dictated by the constitution but not the jungle justice the president adopted.

Abi o. Where were these NBA lawyers when Justice Ayo Salami was forced out by Jonathan?

Fact is the country is suffering from recession caused by the drop in the rate at which crude oil sells which is at $50. We didn't manage to save enough when a barrel of oil was selling at $110 under Pdp regime, hence the mess we found ourselves. Heck, if our foreign reserve wasn't looted from $48b to $26b by Jonathan, we wouldn't be here.

If this sweeping recession could affect a developed country such as Canada, what stopped it from affecting a developing country as Nigeria whose past government looted it dry yet some insane Nigerians are bent on supporting these corrupt folks that plunged us into this mess. Whichever way you look at it, fact is this admnistration is earning 60% less than the previous regime yet has done much more than the past regime. Look at our new railway lines, cheap fertilizer production, rice mills, investing in Dangote refineries, construction of Aba-ENugu-Onitsha roads, Lago-Ibadan roads, increasing our powergrids from 2500-7000 (although only 5000 can be transmitted right now due to poor transmission network), payment of all federal pensioneers, increase of our foreign reserve from $26b to $43b and social programs such as Npower, trademoni etc

If d looting Pdp had done 1/3 of these while earning 60% more as a result of large revenues got from oil selling at high rate of $110 for 16years, we wouldn't be in this mess.

Let me educate you a little, the constitution of the FRN has no provision for "suspension" of CJN, however it has provision for removal which must actively involve the NJC; the highest judiciary body must review whatever petition against any Judge, including CJN, and recommend the removal as the case may be.

Also, the National Assembly is actively involved in the appointment of CJN based on the constitution. They have to approve the person recommended to the President by NJC upon a communique from the president to the national assembly of the intention of the Presidency to apoint the CJN.

These various processes were violated by the presidency and such violations are impeachable offences against the president, just in case you don't know.

You can download a copy of the constitution of the Federal Republic of Nigeria for more information.
