MAJOR TRIBUNAL POSITION
The Tribunal noted the discrepancies between the EC8A Pink copies tendered by PDP and the CTC issued by INEC.

The Tribunal holds that the CTC should and must be an exact replica of the EC8A pink copies. The discrepancies must therefore be explained and justified by the 1st respondent ; INEC.

In this instant INEC failed to explain nor justify the alterations and that they failed to call any witness to justify the alterations.

It therefore holds that the alterations must have been carried out in the absence of the Party Agents to which the Pink copies were issued.

It holds further that the attempt to explain the alterations on the basis of mere corrections of errors is not acceptable and the fact that the said errors were consistently made in the disputed areas means it was a deliberate action taken.

PDP's allegations of doctoring of results is hereby established and upheld by the Tribunal
This is serious if true but there also a need to proof how it affect general results. PDP will still lose.

So you cannot remember the so called affected polling units that stop the APC-INEC to declare the rightful winner of the election again?
Not that, there was no alterations there.it must be the other one that inec reduced pdp votes by 1000

They wont.it affected because the margin of victory is less thqan 1000 so a rerun will suffice

Considering the margin between them, that's quite easy.

How is that easy?Oyetola won with just over 500 votes. The discrepancy votes are a thousand. If it is given in favour of Adeleke, how will pdp lose?

I was referring to the first part of the statement I quoted. We're on the same page.

I don't understand the anxiety here. Two more laps of the whole legal saga to go, irrespective of what the verdict here is.

You're right. However, there's a lot of moral advantage and momentum that comes with a victory here.

Whoever is declared winner here carries the day even.up to Supreme Court and that's if it will ever get there.

They can't award it but if it will make different in overall results, they can call for rerun or outrightly cancel the units results depends on petitional request.

Nobody will be declared winner, the electoral act only gives courts powers to cancel and order fresh polls

im not in court but from the reports read above,im telling it categorically that the verdict will be in favour of APC.
you just dont dump documents and evidence on the court, you must specifically tied the evidence to a particular fact sought to be proved.some lawyers make this mistake everytime, you tender a statement of account and you expect the court to make sense out of the multiple entries in the statment without reffering the judge to the particular entries in favour of your case.who is the pdp's lawyer pls

Nope, a FHC, I think Ademola, threw out that section of the electoral act 2010, till date, no contrary ruling and the FG never appealed the ruling when it was made then, so a court can still declare a winner in an electoral matter.
However, I don't see any groundshaking verdict today, Oyetola will still retain the seat(my opinion)

Pdp scored a major point where they established that there was alterations in some units and the tribunal agreed.there must be a rerun there

This is the major problem in our law system. It's easy to proof irregularity but how it affect your election is very difficult one.
