As far as I'm concerned and if I were a judge, if it's established you're friends with someone and has been having consensual sex together, any reported case of rape between you both is void. I would discharge and acquit the accused.

As far as I'm concerned and if I were a judge, if it's established you're friends with someone and has been having consensual sex together, any reported case of rape between you both is void. I would discharge and acquit the accused.

Assuming she reported in time and was medically examined, if there's a tear in any of the gracilis muscles, that would be an evidence of struggle/forceful penetration. That's what the judge was referring to.

My guy, as par consent, those medical examinations are not 100% definitive. A huge dick+ dry vagina (even wet vagina) can result in a tear. A tear does not prove non consent, it only proves there was sex. Moral of the story, casual sex can lead to real feelings, hell has no fury like a woman scorned.
