Imo State Governorship Battle Returns To The Supreme Court.

The Supreme court must find a way to remove Hope Uzodimma as the governor of Imo state.

The judgement that made him the governor of Imo state is faulty from all sides you want to consider it.

First, the Supreme court in its own judgement on December 19, 2019 stated that Uche Nwosu had a double nomination. That allowed himself to be nominated by AA and APC.

On that premise, the Supreme court nullified the candidature of Uche Nwosu based on double nomination.

The question, if Uche Nwosu was the candidate of APC and AA, which party nominated Hope Uzodimma? On which political platform did he run the 2019 Imo state governorship election?

Was he an independent candidate?

Presently, a Motion on Notice has been filed at the Supreme court. The motion on notice is for the Supreme court to interpret its judgement of December 19, 2019 that said Uche Nwosu was the candidate of APC.

The motion also seeks the Apex court to enforce that judgement, sack Hope Uzodimma as the governor of Imo state and order the return of Emeka Ihedioha of PDP.

When it was in favour of PDP in Bayelsa State, nobody said anything....the same supreme court judgement that made Douye Diri the governor of Bayelsa State also made Hope Uzodinma the governor of Imo State.....

But definitely the supreme court won't rule in favour of the PDP. We should just focus on bringing a wicked person like Buhari so we can hold and clench power like Buhari.

Dead on arrival because Ihedioha raised similar issues in his petition and the supreme court ruled on it. Besides this is a pre election matter which is being filled out of time and has been overtaken by events. Thus it is time barred.


Section 285(9) of the 1999 Constitution is clear on this. This section provides:
285(9):-

“Notwithstanding anything to the contrary in this constitution, every pre-election matter shall be filed not later than 14 days from the date of the occurrence of the event, decision or action complained of in the suit”.

To activate this constitutional clause, a pre-election suit must be filed within 14 days from the occurrence of event or cause of action.


Once the 14 days lapses, the court have no jurisdiction to entertain it. Therefore, a cause of action is statute-barred if legal proceedings cannot be commenced in respect of same, because the period laid down by the limitation law had elapsed.

Secondly the supreme court specifically referred to this issue as a pre-election matter and the time for filing both pre and post election matters has elapsed and the issue being canvassed here is that APC has no candidate based on supreme court judgement on Uche Nwosu of which the supreme court said that it was a PRE ELECTION MATTER in their judgment declaring Uzodima as the duly elected Governor of Imo state...... And you know very well that the Supreme court cannot Double Speak on a matter they have clearly reffered to as pre-election matter which is bound by Section 285(9) of the Nigerian constitution.

Secondly Uche Nwosu & AP case came under Double nomination which I may say is first of its kind in recent times but this one is arguing that APC has no candidate in the election whereas there is a court judgement which has not been set aside till date saying it has a candidate in the person of Hope Uzodinma.

From the arithmetic to the legal reasoning,that SC judgement that installed Uzodinma was error cast and embarrassingly shameful;but in Nigeria where honor is better seen in dogs than office holders;they would soon find another utterly embarrassing reason to dismiss this suit.

The case of Bayelsa was clear, eve year one law state can interpret Bayelsa case judgement, which APC loss in federal high court, Appeal Court and Supreme court but that of Imo supreme court judgement is much kind question mark.
