Background VSP and Redundancy.

For the past 10 years, Chevron Nigeria has carried out several exercises to reduce the headcount of her workforce due to decline in operating activity levels. This has resulted in the release of over 800 Nigerian workers from employment with Chevron Nigeria Limited (CHEVRON) in the course of this period. These exercises were all preceded by robust discussions between Chevron Management and the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN) were amicable agreements were reached. The agreements enabled the Company to carry out a Voluntary Separation exercise which many employees were very happy to accept and leave the company. Today, CHEVRON has decided to embark on a process requiring PENGASSAN employees to reapply to be recruited back into the company after which over 600 employees will be declared redundant. These group of employees will be compelled to leave the company involuntarily. We learnt that a sister IOC recently carried out a Voluntary Severance Package which was concluded without any issues based on humane and labor-friendly terms of disengagement during this same covid-19 pandemic period.

Management unilateral termination of our members.

To achieve the phantom redundancy scenario, CHEVRON Management has drawn up an organizational structure that will relieve over 600 employees of their jobs. Over 2000 employees have been declared redundant with their employment virtually terminated. These employees are expected to jostle for jobs in the ‘new organizational structure’ and until they are selected by Management for one of the available positions, they are literally redundant by applying for these jobs’ contrary to the expectation of the labour act. It is pertinent to note that the entire Management team is intact within the new organizational structure without any loss of jobs amongst them. They will not be affected by the redundancy process.
Violation of CBA by asking employees to reapply for their jobs
This on-the-job recruitment and reapplication process is not covered by the Collective Bargaining Agreement (CBA) between the Management of CHEVRON and CHEVRON PENGASSAN. There is no provision in any Nigerian Law for such a transitory employment status and this is not a practice covered by any CHEVRON Company policy. This unilateral action is illegal, draconian and anti-labor. The CBA has no provisions for Management to ask already employed personnel to reapply for their jobs and stand for recruitment into already existing employment. Chevron PENGASSAN considers this a gross violation of the terms of the CBA.

NNPC approval

Chevron PENGASSAN is aware that the senior partner in NNPC/CHEVRON joint venture, The Nigerian National Petroleum Corporation (NNPC) has asked all International Oil Companies in Nigeria to reduce their operating costs. We, however, are aware that it was not the intent of NNPC to throw over 600 Nigerians in the employment of Chevron Nigeria Limited into the Nigerian labor market. The position of NNPC with regards to employment is evident in the recent recruitment of over 1000 Nigerians into the service of the Corporation. This is also aligned with the goal of the Federal Government led by President Muhammadu Buhari to create One Million jobs for Nigerians every year till 2023.

Refusal to discuss with the Union

The National Body of PENGASSAN had met with the Management of CHEVRON on Wednesday September 30 and after reviewing the issues presented, had requested for further engagements between the CHEVRON Branch Executive Council of PENGASSAN and the CHEVRON Management to ensure there is an alignment prior to commencement of the exercise. The National Body had also directed the CHEVRON Branch of PENGASSAN to revert to her in the event that agreements are reached prior to concluding the engagement. CHEVRON Management, however, refused to meet with the CHEVRON Branch of PENGASSAN citing that they do not consider any further engagements necessary.
Excessive job offshoring resulting to Job loss for Nigerians
The plan to relieve Nigerians of their jobs in CHEVRON and subsequently in other IOCs is being spearheaded by the Management of CHEVRON. Prior to the recent reorganization, hundreds of job functions have been relocated to the United States and other parts of the world to drastically cut out jobs available to Nigerians within the country. Despite the obvious inefficiencies introduced by this effort which has made working more laborious, CHEVRON Management plans to continue with this offshoring which is expected to yield further job losses for Nigerians in the next few years and create employment for Americans using the Work From Home (WFH) concept as demonstrated during this coronavirus pandemic.

Demand of Chevron PENGASSAN

1. Chevron Management must return to the negotiation table with the union.
2. Chevron Management must halt the deployment of the illegal recruitment portal.
3. All jobs which have been offshored will be returned to Nigeria.
4. Chevron Management must adopt best practice in the Nigerian oil and gas industry which is voluntary separation as a means to reducing employee head counts.
