If I go home this christmas to renew, my tax returns and the company's tax return for this year will not be available to DHS so I am less likely to get caught . Right?

I do not believe there is a reason for anyone to check. Except if it is a random check.

Why renew in decenber, does your visa expire then?

My visa already expired but I am allowed to stay in the country as far as I am in status (at least 15 credits in school and no illegal work). That is the way F-1 visas work. However, if I go out and cannot get it renewed I cannot come back in.

I will suggest you do your visa reinstatement ASAP, in the US, before you travel for extension in December.
