This is a two way thing. Firstly, you should know a worker in a private company doesn't have rights , yes , i say so with much regrets but it's the reality in Nigeria. Even if you sue them , they can afford lawyers while you can't. I still wonder the usefulness of NLC. The private sector employs majority of Nigerians while the government only a minor fraction. Lastly, just put it in mind that as long as you are an employee anything you do won't make much of an impact. The new owners would just infiltrate their ranks and that would be the last we hear of this so-called Union. It's been stated in most companies contract that they don't recognize union or association. Though what they demand is Thier right, but in Nigeria what they should be praying for is an employer that would do better. Trust me , ShopRite will open and most of those people carrying plycards would be history.

They are supposed to be paid terminal benefits before they then sign any new contracts/terms of employment.

That is what the law says. That is how every company takeover/sale/buy must be handled.

The Head of HR has brought disgrace to Shoprite and should be asked to resign immediately.

Exactly what they are fighting for. They should be paid off from the sale and asked to apply. Or u asked who wants to reapply continue and those that don’t want to are paid off.

That’s how it shud be done actually. They have a valid case.

You just spoke without experience. Try and get wisdom. Shop rite is playing up trick to avoid them being paid-off. This is why they're taking them to the new owner. The new owner will ask them to reapply and decides who to employ and who not. Those employed could be undervalued (pay less than shoprite) and cut down many benefits. Employees could be maltreated and left to their fate while shoprite is gone.

the workers are fair, first - they are no slaves, their contract is of employment and not slavery which gives them liberty to quit at any time.
secondly - what the are fighting for is their right, entitlement and benefit. at the expiration of the contract with the company they are meant or entitle to it.
don't forget that deductions were made from their wages while still in service with organisation as such they are entitled to their severance package which is the standard world over.
leaving don't mean there won't be no one to work or replace them, there are thousands of unemployed Nigerians who will joyfully replace them so why force them to stay when they felt like no more interest?
leaving for competitors in Nigeria!? I doubt that, shoprite seems about the largest mall around Nigeria more so no competitor would muscle the strength to employ everyone parting with shoprite.
on establishing a competitive mall is a fair business approach (competition is allowed) in as much Nigeria is running a capitalist economy system. if you will come to think of it this workers don't have what it takes to compete with shoprite all 'em put together.

It doesn't make sense to transfer workers to a new employer. The workers will just be at their mercy. Their peaceful protest is welcome.

I don't get it, the new employer is supposed to TUPE the current employees with them. That is how it is done. Meaning the new employer should take on the current employees.
