WHY NNAMDI KANU CANNOT OFFICIALLY REPRESENT BIAFRA ANYWHERE IN THE WORLD- ANALYSIS ~ IFEANYI CHIJIOKE By Kalu Idika Elombah News Oct 2, 2020 It is one thing to take up the microphone of a limited liability company and endlessly shouting one is a leader but another thing to legally or officially stand in the leadership gap for indigenous people. ECOWAS court of Justice is West African regional court and a court of competent jurisdiction, however, any pronouncement by this court is effective anywhere until upturned by a higher court of competent jurisdiction. After ECOWAS court ruled that Nnamdi Kanu has no mandate to represent the people of Biafra; it ended any hope of the self-styled leader of IPOB being part of Biafra restoration now and in the future in all capacities until the ruling is set aside. When diplomacy is mentioned; legal responsibility or legal consideration is the basis of a successful diplomacy and when a man has been pronounced persona non grata by a court of competent jurisdiction, it appears more or less a sheer waste of time to continue to rely on such man for legal or diplomatic success in any agitation. Like Dr. Clifford Chukwuemeka Iroanya once advised IPOB to first and foremost fight against the proscription of the organization in a court of competent jurisdiction to enable the group carry on its activities within legal circle in Nigeria or face legitimate onslaught- Nnamdi Kanu was supposed to appeal the ECOWAS ruling that made him persona non grata in the agitation for the restoration of Biafra but he succumbed and accepted he has no mandate to represent the people of Biafra. ECOWAS court is not a Nigerian court and the ruling was not an ex-parte order granted but a ruling after conscious submissions. Nnamdi Kanu did not bother to appeal the ECOWAS ruling that pronounced him persona non grata in the struggle because he knew he simply came for frivolities and business oriented agitation. Even if Biafra is to be officially discussed anywhere in the world today; Nnamdi Kanu cannot stand for Biafra because the court has warded off legality of or to officially discussing anything on behalf of the people of Biafra with Nnamdi Kanu. This is why reputable organizations have distanced themselves from the man while rogue organizations find it easy to dealing with him. A man ECOWAS court designated persona non grata even though referendum is given to the people of Biafra today, has no legal right or status to sit anywhere and officially speak for or represent the people of Biafra because such is considered illegal and cannot stand by virtue of that very ruling. Nnamdi Kanu can only speak for or represent the people if he appeals the ruling and gets a favorable judgment- thus, setting aside the initial ruling. Nnamdi Kanu was a member of MASSOB and was in charge of MASSOB media; he solicited funds and established radio Biafra station, after establishing radio Biafra, instead of serve the leadership, he decided to project himself as a leader. With radio Biafra; he was able to reach the public and declared himself the leader of IPOB in what was a calculated deceit/coup. Radio Biafra is a sole proprietorship enterprise- a limited liability company and after argument submitted for and against, ECOWAS court in its wisdom concluded that indigenous people cannot be subject of a liability company. Nnamdi Kanu deceitfully claimed a mandate because he had access to mass media where his voice alone was heard- the mandate was tested in ECOWAS court; only for it to be proven illegal and non existing. It is therefore pertinent to understand that no member of IPOB is legally seen as Indigenous person of Biafra, rather, he is seen as member of a limited liability company based in London. Recall that Nnamdi Kanu had approached ECOWAS court to be given a monetary compensation on behalf of the people of Biafra which led to the ruling. The court having taken the decision means nothing can be given to IPOB on behalf of Biafran people.   Even if the world should call for referendum today; a legitimate body will be admitted to represent the people of Biafra and not a persona non grata group/leader.Nnamdi Kanu may have succeeded in dealing IPOB on behalf of Biafran people before the ruling because there was no binding pronouncement, but Justice of ECOWAS having made a legal declaration, Nnamdi Kanu cannot legally present his IPOB on behalf of indigenous people of Biafra again, unless not challenged. Going further, if a court is approached today by over-zealous persons; Nnamdi Kanu can be forced to change the name of his limited liability company as it directly refers to the people of Biafra because ECOWAS court declared him persona non grata in a representative capacity. To continue to parade himself as a leader and representative of the people of Biafra; Nnamdi Kanu continues to disrespect a competent court of jurisdiction and if the court is approached in any case by a Biafran, Nnamdi Kanu is most likely to be fined, deprived and jailed. [/b]It is therefore very important to caution Nnamdi Kanu to apply wisdom and understand the slow movement of a tiger is not cowardice. We can turn blind eye; but his excesses can force us otherwise. [b]Even in UK, Kanu can be challenged in court and successfully detached from Biafra. There is nothing like the Lower Niger Republic. The South South people will have their own republic. Igbo should focus Biafra on South East States. A referendum will be conducted to allow Igboid people of the South South make their choice between Biafra and Niger Delta. |
