It is the state that should be collecting VAT, it's one of the ways peters money is being handed to Paul .
How can some states be generating money while other only wait to collect. That's why many northern states are so redundant and ineffective.
If they want money they should generate it themselves.

But the same Supreme Court gave Bayelsa to PDP. You didn't mention that.

Lagos has previously taken this matter to the State High Court and Court of Appeal, only for the SC to upturn it because it wasn't decided at the Federal High Court. Now, Rivers has taken it to the Federal High Court and the entire North is in disarray.

Why put Tax payers in a difficult position?. A case of between the devil and the deep blue sea. Corporate bodies in Rivers State, I pity una.

It is a simple thing; the standing law has mandated everyone to remit their VATs to the state govt, until it is reversed by higher court or there is a stay of execution, which FIRS has failed to get from the court. Anyone who acts otherwise, especially in Rivers state, only seeks trouble and has himself to blame if the state govt punishes such firm.

Don't forget Rivers state has passed the new VAT into law already.

It's also in Ogun. Though it traditionally belongs to Ilesa in Osun State They just opened their biggest brewery in Nigeria in Ogun state less than 5 years ago

When they won the case sometimes around June this year, that was when Wike saw that he could ride on the Ukala judgement to challenge FIRS statewide. So while Wike can still be considered a hero, he had some precedence to help him out here. The private firm is the bigger hero for starting the chain of events!

There is absolutely NOTHING Buhari can do about this. I just checked the Exclusive and Concurrent lists in the Constitution and there's no way the FIRS can escape this. VAT was introduced in 1993, it wasn't always with us.

Once it concerns legal matters, the North always loses out. That is why you see Buhari running to the South to pick lawyers for his election petition.

The Federal High Court basically says the VAT Act is not a barrier to Rivers State collection of VAT and FIRS can't seem to understand what a court ruling is.The ruling means the status quo changes UNTIL an appellate court decides otherwise.
OK let's wait for the Appeal Court to have its say.

Interesting, it's just amazing that all the other lawyers, SANs, State Attorney Generals never saw this all this time.

EDIT: I did some further digging and apparently there have been many cases challenging the federal govt including ogun state and recently lagos state.

we are already. Nigerians dont know how to impose vat, many items are levied vat multiple times. In the uk, busineses pay ex-vat and only levy vat on their final output. If another business buys that product, he can claim the vat paid (if any) and is only oblidged to pay VAT only on the final product it sells. Thats how VAT should work.

But in Nigeria you will mine and sell aluminium ore (bauxite) and you pay vat , the company rolling it to alumimum sheets will pay vat, the person making roofing sheets will pay vat, the distributtor will pay vat, the retailer will pay vat, when you get a contract the contractor will pay vat again on the roofing sheets. all these VAT paid are compounded VAT on already paid VAT!!! Kilode!!!!

Wheras every body in the process should be able to deduct the vat he paid and only the final consumer is the only one who cannot deduct and therefore pays the total VAT.

thats why it is called value added tax, each time you add value to a product you pay tax on the Incremental value added (e.g turning it from bauxite to roofing sheets) not on the total value of the product.
Everybody in the chain should be able to claim back any vat paid as it is only the final consumer that is supposed to pay VAT.

Yes you know it takes a whole lot of due diligence and confidence to challenge established status quos nationwide. Even at that, Lagos state had also previously displaced FIRS from collecting VAT from Hotels, restaurants and other hospitality companies. I even think the Ukala firm then used that Lagos judgement to push for its application to all tax paying entities instead of hospitality sector alone.

I'm seriously interested to see how the Supreme court will wiggle its way technically around this one to favour FIRS cos the judgement is watertight!
