The Independent National Electoral Commission on Thursday said it won’t take any action on a court judgement sacking Dave Umahi as Governor of Ebonyi State over his defection from the Peoples Democratic Party to the All Progressives Congress in 2020.

The Commission made this known in a statement signed by its National Commissioner and Chairman, Information and Voter Education Committee, Festus Okoye.

According to the electoral umpire, 12 court processes have been received on the defection of Umahi; his deputy, Kelechi Igwe, and 16 members of the state House of Assembly. INEC, therefore, said it would stay action on the matter because of the “conflicting court judgements”

The PUNCH had reported that a Federal High Court in Abuja removed the governor, his deputy and the lawmakers over their defection from PDP to APC. The court also directed INEC to replace the elected officials with new names from the PDP.

Umahi had approached the court to stop his removal but the suit was struck out. The court, however, handed over the case to the Appellate Court.

In its statement late Thursday, INEC said, “It will be recalled that the Commission met on Thursday 17 March 2022 on the matter, decided to defer its deliberation on the Ebonyi cases and stepped down the listed Memorandum to enable its Legal Services and Clearance Committee to study the new processes served on it in the light of the previously served ones and advise the Commission comprehensively.

“Since then, the Commission has been served yet more Court Processes on the same matter, bringing the total to twelve. The Commission deliberated extensively on these cases and decided to further suspend action on the defection of the Governor and Deputy Governor of Ebonyi State and sixteen members of the State House of Assembly from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) in the light of the conflicting judgements and orders served on it from Courts of coordinate jurisdiction.

“The Commission also considers it prudent to stay action on the conflicting judgements and orders being aware of the pendency of Appeals and Motions for Stay of Execution of some of the judgements before various divisions of the Court of Appeal."

This is no news. The appeal is what is being awaited. The Koko is that Umahi must leave office before 2023. As fore the members of house, those ones will be gone before July 2022 as their's would be terminated at Appeal court.

The votes belongs to the candidate and not to the party otherwise parties wouldn't present any candidate during elections. The party is just a platform for a candidate to be presented to the public who then cast their vote TO WHOM THEY DESIRE, because any party without a candidate can't be voted for. INEC is wise. To all those quoting me:

If actually the votes belong to the party exclusively, then you should know how dead your brain and those who made it so are.

It would have been better to have all the members of a party as candidates who equally have same political power as a governor and president than to have a single person who would win the hearts of the people to vote the party.

Dead brains! Now I see why they voted in their "father dead brain" to improve Nigeria's poverty status.

Are you sure you are not the one who is brain dead? The supreme court has ruled severally that all votes belong to a party and not to a candidate. That was how Ameachi became governor of rivers state.

Apparently, you wrote this electoral law in your kitchen last night cheesy because everyone knows that political parties win elections, not individuals. That's why the ballot papers don't recognize aspirants - they have just parties and their symbols.

Whose manifesto won the party election? Was it not the candidate’s manifesto? So since the electorates voted based on manifesto why can’t the candidate remain governor when he took the same manifesto that gave him victory, into another party?

Why will he leave office? This is the only governor in South East and Southern state in general that is doing extremely well in terms of development in relation to income received. Over 10 flyovers with standard road network all over the state

It is immoral to jump ship without any cogent reasons. Unfortunately, that appears to have become the norm in our parts.

On the party/candidate dichotomy, just ask yourself if Sowore won't have performed better had he been the candidate of a major party last time out...
