FG Moves To Release 30 Per Cent Of Prisoners Across Nigeria by Islie: 2:22pm On Oct 09, 2022
Minister of Interior, Mr Rauf Aregbesola, says he will meet with state governors to agree on the mass release of at least 30 per cent of inmates from custodial centres across the country.

Aregbesola made this known when he appeared on the News Agency of Nigeria (NAN) Forum in Abuja.

The minister said that the interface was necessary as more than 90 per cent of the inmates were being held for contravening state laws.

Aregbesola also said that over 70 per cent of the 75,635 inmates at present were awaiting trial.


The minister said that the federal offenders in the system were far less than 10 per cent, adding that the bulk of people in custody were those who have run foul of state laws.

He said that they were therefore being kept under the legal jurisdiction of their respective states.

The minister added that the decongestion of the 253 custodial centres nationwide was necessary as some of the inmates have no reason to remain in custody.

Aregbesola, therefore, said all stakeholders must work towards a “better-structured criminal justice administration, otherwise, we will just be left with congested and overcrowded facilities”.


He said, “I have written to the Nigerian Governors Forum to allow me to come and address them on how they can support the process of decongestion.

“Because the governors must buy into this system for us to do a massive decongestion, especially of Awaiting Trial Inmates.

“If we get the buy-in of state judicial authorities and the government of the states, we can pull out 30 per cent of those who are there.”


According to him, some of the awaiting trial inmates have stayed longer than the punishment provided by law for the crime they were arrested for.

“If you look at a man that is caught for petty theft and you are trying him for three years, even if you convict him for that crime, how long will he stay?

“How long will that fellow stay, probably six months, but without trial, he will be there for three years.


“Again, you arrested a boy under the bridge, there is no fixed crime and he is there forever and so on and so forth.

“So, we need the buying in and support from state governments.

“This is for them to critically know the situation and let them set up committees that will profile all those who are there.

“And help either to convict, release them or see if they have overstayed their required time,” the minister said.

Aregbesola assured that the interior ministry was doing everything within its powers to decongest the custodial centres.

He said that the meeting with the governors would help to critically review the situation and relieve the system of inmates who should have been out. (NAN)

This shows two fundamental issue with prison system. The federal government shouldn't be housing state local inmates. The solution to the is to decentralised prisons. The simple solution to that long term is amend constitution by deleting prisons from exclusive list. The short term solution is NASS pass a law saying The FG will no longer hold Non federal inmates by December 31, 2024 for example. This will force states to build their own facilities and reduce fiscal burden on the FG.

The second issue is the the difficulty in getting bail in Nigeria. If States could determine their own bail requirements by law or have guidelines for judges we would have so many sitting in jail. The next big solution is offering guilty inmates time served while sitting in jail on trial. Again it reduces fiscal burden and they served their punishment anyway.

ps: It's sad Nigeria current statesman like Aregbesola and Buhari aren't very strategic or smart. Since Prisons are in the exclusive list you can just force the responsibility in the states if you please. Use the Majority post in NASS for something useful. This would give leverage to force states to delete prisons from the exclusive list. Yes strong arming is better than slow consensus building and endless meeting in this case.

How many state Judges monitors their respective state police formations even though it is their constitutional duty to do so monthly to access this same situation.

The problem with Nigeria is corruption and the lack of will for the people in position of government to do their job. If state Judges use their power as they should, there are so many cases that shouldn’t have gone to court because these police arrest people without any evidence and that’s where the problem starts.

lol if your Boko Haram or Any other violent criminals get released into your street just know the governor approved it. Alot of these guys can be cut a deal by the prosecutors like time served if they admit guilt and be released. Alot of them stayed longer than their max sentence anyway. If it's a misdemeanor maybe see about expunge record who knows. If its state offenses were talking about then the state assemblies will need get involved eventually.

There are inmates who had no business spending up to 2 years in prison for their offense, but have spent more than 20 years awaiting trial. Nigeria is NOT a working nation!

I don't know the answer to first question. The second paragraph I would disagree with. Before a case goes to court Department of public prosecution recommends it based on the evidence. If the feel the case is too flimsy they won't take go waste time. Nobody likes losing or wasting their time. Judges throw out cases for lack of evidence but most have sufficient evidence to merit a case.

Cases move slow in Nigeria see because their isn't that many many judges for the amount of cases. Texas probably has more judges than all of Lagos and Kano combined

everything you said is actually very important things that needs to be done. To fix Nigeria,we need to amend our laws. With current set up, even Jesus will fail as president of Nigeria.

We need constitutional amendment to be able to fix the systematic rot in Nigeria

state governors will not sign death warrants keeping inmates on federal government bill.

Let them take up the bill and see them ensure that flimsy cases don't go to prison. Even police will think twice to arrest someone because you will be forced to prove the case.

Bail will eventually become free cause the police will do everything and anything to offload stupid cases

You’re telling me the majority of those arrested by Sars thrown into Jail have evidence You’ve probably never encountered a police problem before so I won’t want to have an argument with you. Back in the day as a young man, during Christmas period, police goes about raiding people on the streets into their danfos, only those who got immediate cash are let go, the rest you go sleep cell next Monday you go to court, from there to remind for late night movements.

I’m talking about real life situations here, Police stations are filled with cases that shouldn’t go to court, Judges don’t know anything about the case except you have money to spend on the Police IPO, the judge will send you to jail for remind with one flimsy excuse from the IPO.
