The Independent National Electoral Commission (INEC) has admitted that there was over-voting in the July 16 governorship election that brought in Ademola Adeleke as Governor of Osun State.

A Deputy Director in the ICT department of the INEC, Mrs Abimbola Oladunjoye disclosed this while giving evidence before the Election Petition Tribunal hearing the petition filed by Mr. Adegboyega Oyetola and the All Progressives Congress (APC) against the declaration of Adeleke as the winner of the election.

Being cross-examined by the Petitioners' counsel, Chief Akin Olujinmi SAN, Oladunjoye who was referred to as a star witness of INEC admitted that in Ward 4 unit 7, Ede South Local Government, there is an over-voting of 75, as the figure of accreditation on the BVAS report presented by INEC is 313, while the result on form EC8A is 383.

Oladunjoye's attention was also drawn to paragraph 21.36 of his witness statement where she stated that the accreditation figure was 830, but in the BVAS report presented by INEC, the figure of accreditation is 793, admitting that there was an over voting of 37.

The witness also admitted that in paragraph 26.7 of his witness statement, there is an accreditation figure of 402, while the accreditation figure on the INEC BVAS report was 263, admitting that there is an over voting of 139.

Also in paragraph 23.24 of his witness statement, Oladunjoye agreed that the accreditation figure she mentioned was 448, while the accreditation figure on BVAS was 224, admitting that there is an over voting of 224.

The witness who said under cross examination that she was not a Presiding Officer on the election day said, it is only the Presiding Officers that have explanation on what transpired at the polling units on the election day.

The INEC representative who admitted that she signed and certified a BVAS report for the Petitioners, further said that the copy of the report was different from the one issued to the respondents, adding that she never indicated that the report issued to the Petitioners was an interim document which would be subjected to synchronisation.

She testified that the synchronisation was done after election result had been declared on July 17, 2022 and BVAS report had been issued to the Petitioners on July 27, 2022.

Done with the cross examination of the witness, Chief Olujinmi hinted that the irregularities identified in the BVAS report presented by INEC was just a tip of an iceberg, saying, there are loads of over-voting during the election.

Earlier, the tribunal had admitted as exhibits the load of BVAS machines and CTC of Form EC8 series brought to the tribunal by the INEC counsel.

After the Cross examination of the witness, the INEC counsel, Professor Ananaba informed the court that he would no longer be calling any other witness, as he applied to close his case.

Counsel for Adeleke, Onyeachi Ikpeazu subsequently opened his defence by tendering form EC8 series used for the election.

However, the tribunal raised issue as to the safe custody of the BVAS machine tendered and admitted in evidence, as the panel ordered that the machines should be kept in the Central Bank Vault in Osogbo.
The tribunal then adjourned till tomorrow, Thursday.

Same BVAS some people are saying is foolproof? I laugh when some people seriously believe that the BVAS will eradicate rigging. The rigging this time will just be on another dimension different from the traditional one we are used to. But that this election will be devoid of rigging? capital NO. It might however not be as brazen as before.

I still maintain though that "You cannot rig where you are not popular"

Guber Tribunal: INEC defends Governor Adeleke’s victory, says there was no over-voting



The Independent National Electoral Commission(INEC) has launched its defence of the July 16th victory of Governor Ademola Adeleke, positing that over-voting can only be proven through comparison of server secondary data with primary data in the BVAS machines.



In a very revealing disclosure for the the second straight day of defence, the electoral body faulted claims of voting as emanating from lack of understanding or deliberate oversight on the part of the petitioners on the working of the voting machines.



In a presentation by the witness from INEC, Abimbola Oladunjoye, the Tribunal was told that after the election, the electoral body had to embark on a synchronization process after which data will be transmitted to the backend server.



According to the witness, if there is no network on a BVAS machine, the information will not be transmitted to the back-end server. This makes the back-end server an unreliable source to determine over voting.



On the previous data provided a team of lawyers from the All Progressives Congress(APC) , the INEC witness said it was to fulfil the spirit of the freedom of Information law which mandates the commission to provide information sought within a stipulated number of days.



While explaining that the commission deployed 976 BVAS devices to cater for some large voting centers during the election, the commission affirmed that over voting cannot be proven except through diligent comparison between form EC8A and the physical BVAS Machine.



“The earlier report as at 22nd of July was in fulfilment of the FOI law mandating inec to provide response to information sought. As at this time, sychronization of data was still ongoing at the inec server backend”, the witness noted.



The sitting at tribunal was punctuated by intermittent adjournments even as the the BVAS machines used at the challenged polling units by APC counsels were brought to court today.



It will be recalled that the total sum of 976 polling units were falsely alleged for over voting.



However, Mrs Oladunjoye who is a deputy director of ICT department cleared the mess by thorough explanation before the tribunal today.



She further established that a BVAS machine was deployed to where the total registration of voters were more than 750, stressing that the primary source of overall result was form EC8A, BVAS machines and the registered voters.



The details were given on how failure of network can cause awkwardness for transmission of the result to the headquarters. She thereby said the result will remain on the BVAS storage.



According to OSBC Judicial Reporter, the sitting continues on Thursday.

there’s no form of over voting in July 16th governorship Election. The Election is free and credible. Our votes were counted accurately on that blessed day.

Inec admitted or defended thier statement that there wasn’t over voting and if there is, it can only be done by server compromise, which inec doesn’t have any server users for the governorship election. Stop telling lies

the clueless op that posted his own version is of APC. APC twist the details of the tribunal yesterday. Check punchng and vanguard online newspapers this morning about the details of the tribunal sitting yesterday. APC and Oyetola ti lule piii Lekan siii. No hope for APC and Oyetola in the tribunal court of justice in Osun State. Oyetola cases will be dismissed for lacking merit. Oyetola cases never hold any water.
