I was working with a company since late 2015 and my appointment was terminated yesterday.

What was contained in the contract letter was that I either give a month notice or return a month salary in case I want to leave and vis Versa.

The HR called me that I will be paid for this month which I think I am already entitled to, having work for half of the month already.

I feel the company has already breached the contract agreement else I am to be paid at least have of the month I have already worked for.

Please the lawyers in the house should advice me before taken any step.

You have the right to sue anybody you wish to sue. But note that, you will not always win because you sue someone.

2015 till now is about 8yrs. Are you talking about just one month upfront payment? No other pay off? What type of company do you work? You have better thing to sue for my dear.

why was ur appointment terminated..normally you only get paid for the period you work for the company, except otherwise stated.
That clause u mentioned is usually applicable if YOU are resigning from your job. In your case, your employment was terminated.
Talk to a lawyer sha, and read the terms of your contract very well.
You can sue if your employment was wrongly terminated but i am not sure about the company giving u 1month notice or paying u 1 month benefit

Just head to National Industrial Court straight. Employers especially private businesses are fond of breaching employment contracts these days.

I had a friend who suffered same fate some years ago. They gave her a sack letter and refused to pay her off. Told her she'll be paid at the end of the month.

She immediately sent WhatsApp messages to us her friends narrating her ordeal. I didn't know how she did it, but the mail we later got from her made us look like a group of Lawyers. Believe me none of us were Lawyers. Based on the fact that she has hinted us of what was going on, we played along and started asking her series of questions. We told her to get the name of the CEO of the company to enable us sue him and the company for breach of contact. Remember the company was in copy of the mail.

Surprisingly that was how she was paid off.

You can try doing same, praying it works.

Do you have the money, energy and time to file a case as an employee against your employer?


Some naija employers could be very wicked that instead of paying you the 100k salary advance in the event of terminating ur appointment would rather set aside 1m just to use it to frustrated u in a Court.

I've witnessed this sometimes in Lagos

Siraj1402, You can sue.

There is an industrial court to adjudicate on this type of issues

You can also use the public defenders court in Surulere, the process can be cumbersome but they will do a good job

You think Nigerian employers will ever pay salary for less than a month work? *Laughs in French*. Sope otilo! The day Nigerian employers pay salary for less than a month work is the day hell will freeze over! I am a victim too! There is nothing that can be done except if you are willing to put a lot of money in and sue for damages (mental distress and all what not) too!

Best advice! At the end, they get their recompense back one way or the other! Karma can't be missed, it might just take time!

Yes you can use...check your contract letter, you may have an arbitration clause there.

Suing / arbitration costs money so if you do not earn enough to cover legal fees then you'll lose more money. Best case scenario ...you win and get your 1 month extra salary and costs. Worst case...you lose and end up paying lawyer fees.

Check if you have a union and report the matter. They'll picket the company and you may get your money.

Mtchew instead of looking for how to establish yourself through a business, how to emancipate your lineage from seeking employment. It's how to sue an employer over one month salary.

This thing nor clear

1. You've been paid for December 2022 right?
2. January 2023 has not ended
3. You were terminated yesterday 16th January 2023
4. HR promised you will be paid for this month
5. Contract says you are to give a month's notice or a month salary in lieu of notice
6 What did the contract say about employer terminating you?

For number 6 most contract would say employer can terminate you without notice but you need to confirm that on your contract. Its not always what the contract expect you as the employee that applies to them as employer.

Yes you can sue if you find out that they've breached the contract ...but won't it be too expensive for your to sue than what you will get as salary? You may sue for damages but the case may also drag for who knows when. You don't also want to burn bridges, your new company may require reference from the old who knows ....think before acting though. All the best
