seunmsg: Going to jail for what? He will go by the Supreme Court ruling. Old naira notes will be legal tender till 31st December. However, where will you find old naira notes? CBN will never bring back the more than two trillion old naira notes it has already recovered. Banks will be free to accept old naira notes and old naira notes will be accepted in the country as legal tender. But how much old naira notes will be in circulation? CBN has already achieved its objective. |

9jaRealist:have you ever heard that there are two types of constitutions which are the written and unwritten constitutions? Previous Supreme Court rulings form part of the unwritten constitution. If u don't know this, try and learn instead of arguing, we are all here to learn. |

I am not even sure that was a relief requested by parties to the case, so why not indefinitely? Or (since it argues that the process was illegally implemented) until the process is properly and legally implemented? Instead, by determining the December 31 time period for old notes to remain legal tender, the Supreme Court has INSERTED itself into the policy-making process and has SUBSTITUTED its own substantive policy over that of the President and the CBN Governor with respect to currency management, an area that is constitutionally and legally the EXCLUSIVE preserve of the latter. Courts are neither empowered nor equipped to make a substantive determination which government policies are ‘good’ or ‘bad’, or to CHANGE substantive (executive or legislative) government policy. The constitutional power of Judicial Review granted to the judiciary is limited to determining whether laws or policies were wrongly or rightly made, not which different dates/substance should apply. This judgment risks sacrificing confidence in the substantive neutrality of the judiciary on the altar of short-term political expediency. > |

oz4real83: Yes, there are 2 types of constitutions… And Nigeria has chosen the WRITTEN type (as opposed to the UK, for example, which has the “unwritten” type). The ONLY way to add to our written constitution is by LEGISLATIVE amendment (federal and state)… Supreme Court rulings merely INTERPRET our written constitution, it CANNOT “create” new constitutional provisions! > |
