Oyetola Vs Adeleke:

Important points from today's Judgement of Supreme Court;

1.BVAS does not operate in isolation of voters register, therefore voters register is relevant to the conduct of election.

2. Supreme Court adopts BVAS as the primary source, exhibit BVR by Oyetola dismissed.

3. INEC regulations does not provide for transportation of accredited voters to the database except snapped pictures of results for form Ec8A to the IREV - Court holds

4. Since the BVAS is the foundation of the Appellants' case, failure to produce the BVAS was fatal..

5. Appellant failed to prove overvoting

6. On APC and Oyetola’s witness

“He has no personal knowledge of the case,
He was not present in any of the polling units,
His entire testimony in the case is incurable inadmissible”

7.Supreme Court: Adeleke ought not to have even defended any of the allegations of Oyetola because they are based on hear say.

8. Adeleke qualification was settled already - Supreme Court

9. Appeal failed and hereby dismissed

- Supreme Court holds.

The victory here is not for Adeleke but for INEC which Adeleke was just a beneficiary. INEC tried to defend her integrity and Adeleke that was earlier announced as winner as not being a mistake. With this win for INEC which Adeleke has benefited, take home here is that INEC will also win presidential court case of which Tinubu will be beneficiary like that of Adeleke. INEC will like to defend her integrity by dwelling on Bvas data source which will favour INEC and Tinubu. The remaining personal charges against Tinubu holds no water. INEC/Adeleke winning in Osun means Obi will loose because court will rule in favour of INEC like that of Osun

The primary issue in contention has to do with adherence to the Electoral Act including the use of BVAS as primary source of data. Recall, that BVAS as being alleged not to have been used in close to 10,000 PUs (hence results are not even uploaded even till now).

I like your logic, in essence INEC would have to defend it's declaration that APC won. This is very good news, because they would have to do so with BVAS, Voters register, EC8A and AWS. When you look at their filed response, you'd realize they are as much clueless as they were on Feb 25th. We want to see how they will defend the irregularities from their own instruments. The prosecution should rely more on digital forensics not backend server and INEC would mess up themselves.
