Do they have anything serious against the election results?

Both Obi and Atiku have the results as collated both manually and electronically, and they know they lost hence the issue of $460,000, citizen of Guinea, 25% in FCT and Shettima double nomination. On the main issue of election results, they've lost it.

All these are technicalities which the court would not base his judgement. So their presence in court is to whip up sentiment and public sympathy.

Unfortunately for them, Tribunal is not a place of emotion.

The judges must take their time to examine the prayers of the petitioners to avoid reaching their decisions per incuriam.

It is standard practice anywhere in the world.

The date set out for Election Petition in Nigeria is longer than most countries because of the diversity in Nigeria and our perculiar electoral system.

For instance, in the US, an Election Petition against an elected President of the Republican Party would only be brought by the Democrats.

In Nigeria, the law envisages a situation where all political parties that participated would bring their petition against the winner.

About 18 political parties participated in this election, more than 30 participated in 2019. There's no law that stops all of them from petitioning the victory of the winner. It is the very reason 180 days is fair for the completion of the process judiciously.

In law, he who alleges must prove. Tinubu does not necessarily need to prove that he won but the petitioners must prove that he didn't win. The petitioners must gather sufficient evidence to prove that they won instead.
It therefore follows that the chances of the party INEC declares winner are always higher than the chances of a petitioner.

The long length of time favours the petitioners since the burden of proof is weightier on them in the balance of probabilities.
Those Obidients lawyers want court to handle this kind of case in 14 days. We can only achieve such by,
1. Only runners up can challenge the election.
2. The only ground of petition should be limited to only " Not score highest number of Lawful votes "

casualobserver:

Let me take these so called issues one by one

1. Narcotics. He wasn’t convicted, even if he was convicted, according to the constitution it does not disqualify him because it was over 10 years ago.

Section 137. (1)e. (e) within a period of less than ten years before the date of the election to the office of President he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the Code of Conduct; or

2. 25% of FCT. Section 42(1)b. States

1) A citizen of Nigeria of a particular community, ethnic group, place of origin, sex, religion or political opinion shall not, by reason only that he is such a person:-
(a) be subjected either expressly by, or in the practical application of, any law in force in Nigeria or any executive or administrative action of the government, to disabilities or restrictions to which citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions are not made subject; or
(b) be accorded either expressly by, or in the practical application of, any law in force in Nigeria or any such executive or administrative action, any privilege or advantage that is not accorded to citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions.

3. Whether or not he presented a forged certificate in 1992, 1999 or 2003, The issues before the tribunal is Did he forge the certificate for this election? If not you have no case, Adelekan forged certificate in his last election, today he is governor because the certificate he presented this time is not forged.

4. Inec not following rules. Supreme Court has just ruled yesterday that INEC does not have to transmit results to IREV. It is a guideline not a law.

5. You may have a case here, this is the one I don’t know how the court will determine. But if it rules against Tinu u then Obi is also disqualified for not being a member of Lp 30 days before primaries.

6. This will be determined by the evidence. Obit will have to prove he won more votes than Tinubu. I can’t comment as I haven’t seen his evidence. All I can say is that even if he can prove he got more votes than Tinubu, unless Tinubu is disqualified outright, the election goes into a rerun and obi cannot win a rerun against Atiku or Tinubu.

7. Citizenship. Diplomatic passport is not citizenship. Countries give other nationals diplomatic passports for different reasons without them being citizens. A good example, when NADECO members fled Nigeria via Cotonou, they were issued passports of other countries to enable them flee to Europe and the US. Tinubu himself said this is his biography that he was issued a UK passport to enable him land in the UK. Sometimes small countries issue influential people diplomatic passports. It does not make them citizens or mean they are citizens.

The only issues here are is 5&6. The others are dead on arrival.
Let me counter your submission.
1. On whether the conviction is over 10 years or not or his forfeiture of $460,000 falls within that ambit of that section, the tribunal will let us know.

2. On 25% at FCT. The quoted section does not answer anything, except you wish to expatiate the more for clarity.

3. That forged or not forged rest on the tribunal to make decision on that but for me that prayer is inconsequential and irrelevant.

4. You lied here. What the Supreme court is as posted below in the poster. Oyetola based is case on hearsay and not what really happened at the polling unit. He claimed there was over voting but never back it up with voters'register, BVAS and the results posted on the IREVs. Because that was the three components that can show there was over voting and that was why the supreme court said, Adeleke never even need to counter anything because Oyetola only base his case on hearsay.

5. I think your number 5 was on double nomination and not being a member of a party. That Shettima was on double nomination which was against 2022 Electoral Act, which I think the tribunal will give interpretation to. Again, the Appeal Court had made decision if the validity of Obi as a member of LP and I don't see Tribunal overruling itself. See the link below:

6. You cannot say one person cannot win another because you may not know the kind alignment and realignment that can come up.

7. My brother diplomatic passport are given to citizen of a country for ease of entry to another country when on an assignment for their country and not giving to non-citizen. Please google who is entitle to diplomatic passport and don't let Bayo Onanuga confuse you. If truly he is given diplomatic passport, it means he has truly acquired the Guinea citizenship. Country only give people Honorary Citizenship and not passport, which many of our politicians have.

INEC breach of its regulations is not the only thing Petitioners must prove.

Tinubu did not win 25% in Abuja needs no proof.

Tinubu's perjury on dual citizenship that he denied and did not mention to INEC requires no proof.
Tinubu's issuer of Primary and O'Level Certificates that he has been unable to demonstrate does not require proof.
Tinubu's refusal to mention his forfeiture of $460000 proceeds from drug trafficking, is perjury.
sound minded people are discussing issues constructively, here you are saying things that doesn't tally with the matter. PERJURY is difficult to prove, Also the PERJURY you are referring to was not part of the original case filed by LP and PDP. They can just wake up and start cherry picking. Just watch as some of these will be thrown out.
All other things you mentioned are nonsense.
The constitution does not prevent you from contesting as a president of Nigeria even if you have dual nationality. Even if you are born overseas and you have Nigeria heritage, father mother you can contest

It's not false.

That's exactly what I'm saying. The period to conclude their election petition is shorter because they're only two parties involved. In Nigeria, 18 parties are involved in 2023. They were more in 2019. Five political parties filed petitions against Tinubu's victory, two of them have withdrawn their petition. The court will now deal with three separate petitions as against the American court that would deal with one petition.

Let's say all 18 of them filed and no one withdrew, the court would deal with 18 separate petitions as against America's one.

The court has to treat their files separately and then come to a final conclusion. For instance, today was slated for Atiku's case alone.

It is why 180 days is provided by law for the conclusion of Election Petition Tribunal in Nigeria.

Try to comprehend a message before criticizing.
So after tribunal Dey would move to Appeal Court and from there to Supreme Court , this case fit last for 4 years oooo

The guy is saying the truth. The 25% in FCT just require interpretation of the constitution. Petitioner should prove that he was the one that wrote it or his elder sister. What does the petitioner need to prove there? It's just require constitutional interpretation. Say you see that it is you that something is psychological wrong with and you lack simple assimilation of words.

The dual citizenship/ perjury is not a fact in issue. It was not pleaded by the petitioners in their petitions therefore they can't adduce evidence to support nothing.

The 25% issue is declaratory judgment. The court does not need arguments here because it will be sitting to interpret the provisions of the Constitution.

The rest you mentioned have nuisance value.
