let take a look at section 77 of the Electoral Act, 2022, my emphasis will be on sub section ( 3
section 77 of electoral act statete that:

(1) A political party registered under this Act shall be a body corporate with perpetual succession and a common seal and may sue and be sued in its corporate name.

(2) Every registered political party shall maintain a register of its members in both hard and soft copy.

(3) Each political party shall make such register available to the Commission not later than 30 days before the date fixed for the party primaries, congresses or convention

By interpretation of section 77(3) of the Electoral Act, 2022, obi was still a member of PDP at the time he was sponsored by the Labour Party and was screened as one of the party’s presidential hopefuls in April 2022 while labour party might have summit it registered form to inec without obi and Yusuf names on it.

“Obi and others resigned their membership of the PDP on 26 May 2022 and joined the Labour Party the following day being 27 May 2022.

“(Labour Party) conducted its Presidential Primary on 30 May 2022 which produced (Obi) and datti as the candidate it intended to sponsor in the General Election That is to say, the said register of members must have been submitted to (INEC) on or before 30 April 2022 and obi name might have been summited by PDP.
Whereas, by the mandatory provisions of Section 77 (1) (2) and (3) of the Electoral Act 2022, a political party shall maintain a register and shall make such register available to the Independent National Electoral Commission (INEC) not later than 30 (thirty) days before the date fixed for the party primaries, congresses and convention.
conclusively this is to says that obi was not qualify to contest under labour party and labour party are looking for mandate without a presidential flag bearer.
