In a landmark ruling, Abuja High Court has dissolved the parallel executive committees (EXCOs) of the People’s Democratic Party (PDP) in Rivers State.

The court declared that the EXCOs responsible for nominating Siminialayi Fubara as the party’s governorship candidate, in the primary were not the authentic EXCOs recognized by the Independent National Electoral Commission (INEC).

The case, with suit number W/6084, was brought before the court by representing of “the genuine state executive committee members of the Rivers PDP”.

The defendants named in the case were the PDP, along with Amb. Desmond Akawor and Dr. Benibo George, who were part of the parallel EXCOs that was dissolved, and INEC.


The court’s decision has now raised doubts about the legitimacy of Siminialayi Fubara’s candidacy, his subsequent victory in the March 18 governorship election and the entire electoral process.

The ruling of the Abuja High Court discrediting the parallel EXCOs has significant implications for the political landscape of Rivers State.

1. It is the National body of any Political Party that is in-charge of Governorship Primaries, so the sack of the EXCO has no bearing on Fubara.

2. The FCT High Court has no territorial jurisdiction for a cause of action that happened in Rivers State. This has to do with the leadership of the Party in Rivers State.

The SC made that clear in the case of the Shekarau/Ganduje APC factions at the State level (Mutlaka Bala Sulaiman and others v. APC & Ors).

The suit should have originated from the High Court of Rivers State or Federal High Court.

ONCE THERE IS NO JURISDICTION, EVERY OTHER THING FALLS FLAT.

3. The complaints of the petitioners was that they were elected on 21st March 2020 for a 4-year tenure and were kicked out before then.

“A political party is a voluntary body with its rules, regulations or guidelines which if you agree to be a member must obey and work within the rules’’. per Adamu Augie JSC (Dele Moses & Ors v. APC)

It is the internal affairs of a Political Party and the Court has no business with it.

Why do you think Wike has beed romancing and frolicking with Tinubu ever since?

Atiku and PDD national Rxcos can seize this opportunity to deal with wike but they can't do it as Rivers money funds half of PDP yearly budget.
