The statement comes as Nigerians intensify criticism of the Supreme Court over its decision to allow President Bola Tinubu to remain in office despite forging a school certificate.


Mr Dattijo, who retires on October 27 as he clocks 70, lamented the tragic turn of fortune for Nigeria’s highest court, saying it has become a body chocked by bribery and perversion of justice because many of those on the court have no clear understanding of what it meant to deliver justice to the Nigerian people.

“Public perceptions of the judiciary have over the years become witheringly scornful and monstrously critical,” Mr Dattijo said at a farewell ceremony held in his honour in Abuja on Friday. “It has been in the public space that court officials and judges are easily bribed by litigants to obviate delays and or obtain favourable judgements.”

Mr Dattijo indicated he was not the only justice with an unflattering review of the judiciary while on the way out, citing a similar observation made by a former justice of the Court of Appeal, Oludotun Adefope-Okojie, who retired in May 2023 at 70.

Mr Dattijo said Mrs Adefope-Okojie, while retiring, lamented that justices at the top levels of the Nigerian judiciary have failed to amend their corrupt way even as the public anger intensified.

“Pleas are expressed every day by the generality of the public begging the judiciary to be just, to be truthful, and to save the country from collapse,” the justice said.

While further citing Mrs Adefope-Okojie more extensively, Mr Dattijo recalled other parts of his retired colleague’s observation of the court’s descent from grace.

“My question is whether the judiciary needs to be begged or cajoled? What is it that qualifies any person to bear that exalted name ‘Honourable Justice’? Is it not for him to administer justice without fear or favour?

“Unfortunately, it has been severely vilified with the Apex Court so denigrated and called by a social commentator as a voter gaggle of useless, purchasable judicial bandits.

“How did the judiciary get to this level? Why is the whole country on edge for fear of what the public regards as unpredictable judicial pronouncements? There must be a rethink and a hard reset.

“If the people we have sworn to defend have lost confidence, there is a problem that must be addressed,” Mr Dattijo noted in his emphasis on Mrs Adefope-Okojie’s remarks.

The statement comes as Nigerians intensify criticism of the Supreme Court over its decision to allow President Bola Tinubu to remain in office despite his violation of the Constitution with his decision to present a forged academic document to the electoral office INEC.

Section 137 (1)(j) of the 1999 Constitution (amended in 2010) specifically states that no one would be legitimately elected president of Nigeria if the person “has presented a forged certificate to the Independent National Electoral Commission.”

Mr Tinubu had, on June 17, 2022, submitted a certificate that he claimed was issued to him by Chicago State University in 1979. The school later said under oath that the document Mr Tinubu presented did not emanate from its offices and there was no record of him applying to get a new certificate.

While most Nigerians expressed little confidence that the court would follow the Constitution and remove Mr Tinubu from office to save Nigeria’s reputation, the justices’ decision to sidestep the forgery by claiming the evidence came too late was nonetheless seen by many as further evidence that the judiciary had been captured.

A seven-member panel of the Supreme Court, led by John Okoro, said Atiku Abubakar, Mr Tinubu’s main challenger who obtained the evidence of forgery from the United States, was late in procuring the evidence, even though the court had several precedents in which it allowed additional evidence to be tendered in a case, especially if such evidence could potentially tip the outcome of a case upon admission.

A spokesman for the Supreme Court did not immediately return a request seeking comments about Mr Dattijo’s remarks on Friday.

Mr Dattijo was born on October 27, 1953, in Niger State. He was formerly a court clerk before becoming a judge. He was appointed to the Supreme Court on July 10, 2012, by President Goodluck Jonathan. Despite being the second most senior justice on the court, he said he was not given any official roles or allowed to contribute on issues bordering on critical decisions of the court.

Chief Justice Kayode Ariwoola, who was present at the event and spoke before Mr Dattijo, was on the receiving end of some the criticism when his colleague raised concerns about how children and spouses of judges and justices are now increasingly joining the bench themselves.

Mr Ariwoola’s son, Kayode Ariwoola Jr, was among those inducted into the Nigerian judiciary in July 2023. The development itself followed an earlier report by Peoples Gazette, which exposed how Mr Ariwoola tried to meet Mr Tinubu in London following his election. Mr Ariwoola did not deny being in London for the unclear but highly suspicious trip, but he released a video saying he was in Abuja but without saying when he returned to the country.

Earlier this month, Mr Ariwoola came under public criticism for expressing disdain for the opinion of Nigerians on the judiciary, urging judges to ignore public perceptions when handling cases.

In December 2022, Mr Ariwoola was questioned by the State Security Service for publicly expressing partisanship in Nigeria’s upcoming election scheduled for February 2023. The chief justice had commended some opposition elements for working to sabotage Mr Abubakar, Nigeria’s opposition leader of the Peoples Democratic Party, in favour of Mr Tinubu.

Although the Supreme Court issued a statement denying Mr Ariwoola made the statement, a video that subsequently surfaced online showed the court lied and the chief justice indeed made partisan statements during an event organised by Nyesom Wike in Port Harcourt.

There is an old Chinese proverb about the bull in the China shop. It goes into a China shop, thrashes everything and then is not sure what to do thereafter.

The government of Buhari took the economy from bad to worse with one failed policy after the other.

Now another APC government has forced it's way into power with the handwritings on the wall not telling a good story; the realities looking even more grim than things were with the last APC government

It would seem like there are similarities to be drawn between APC and the bull in the China shop.

Gone are the days when men cared about their reputation and the legacy they left behind. Not anymore. We are in snatch and grab times, with democracy and justice for sale to the highest bidder, and the bonds that are supposed to hold a country together are being trashed left right and centre.

The damage that has been done with the glaring hijack of our electoral and judicial processes is not likely to be undone anytime soon, just for power, and personal gains.

God save this country.

There is nothing wrong when the win and the loss you speak of occurs fair and square, in a process that is open and transparent.

But we are not even talking about the obvious irregularities that occured during the elections. That horse has since bolted

But when you have the judiciary that should be the last hope of any system now begin to champion and rubberstamp daylight fraud and a blatant rape of everything that is right, just and true, then we are entering a whole new territory of witchcraft that any right-thinking person no matter the party, creed, religious or ethnic affiliation should know to distance themselves from, because the consequences of that don't bode well for the future of this country.

Dear foreigner reading this, ignore the misleading headline or message. NIGERIANS do not HATE the court, a people from within the boundaries of Nigeria, and largely from a particular tribe, who call themselves Obidient Biafrans, are the ones who hate the court.

Let that not surprise you anyway. They're generally known to hate and try to destroy anything they can't control or any process that doesn't favour them. They do not only hate the court, in fact, they've called for the destruction of the country on several occasions.

Do not be misled by their antics. Whenever you see such headlines, replace the name Nigeria with Obidient Biafrans. That's what it is.

Then, we didn't have the accreditation system that came before BiVAS, or the BiVAS or the IREV itself, which was the whole reason the Uwais panel was set up by yar adua who was the first person to admit he had come to office thru a flawed process, and of course, the report and the electoral reforms that followed.

The person there in aso rock now does not even see anything wrong in the process thru which he got to power. Infact he has been going up and down the street touting how free and fare the process was which is as far from the truth as night is from day.

So frankly, there is no basis for comparison between the elections of 2007 and 2023. What happened to all the reforms we thought would make the process credible and transparent? They were brazenly set aside.

The only thing that APC has to show as their claim to winning the last elections is the fraudulent number they were handed by a severely, deliberately compromised INEC. They themselves don't even have the proof, it doesn't exist. The proof that would have shown they themselves came a distant third was allowed - again by the same supreme court - to be deliberately destroyed by wiping off the evidence on the BIVAS in preparation for the governorship elections.

Then you had the same INEC deliberately withholding evidence that would have shown the true results of the elections, while the supreme court that the opposition had made several cases to, refused to compel INEC to do the needful.

Don't even get me started on IREV and the blurred results and non-election result-related material that was deliberately uploaded thereon. Or the multiple cases of mutilated results that did somehow manage to be visible.

My point is, we have never an effort this brazen to destroy the constitution and the structure that uphold a society as we saw during the last elections, and am talking about:

Voter confidence - destroyed

Image of the country - damaged

Confidence in the judicial system - destroyed

Credibility of Nigeria as a serious country - Gone.

Even the belief in the strength of systems in country both internally and externally, severely shaken, because if a proven fraudster a certificate forger (and whatever else we are even yet to discover) can be allowed to take the exhalted position of president, and there's nothing wrong with that, then it means anything can go, which also means you should be very concerned.

So, it makes one wonder, is all these just because of one man's ambition? Or are there other sinister forces and interests behind all these that are yet to be laid bare?

Only time will tell, but whatever it is, like I said before, God Save Nigeria and the good people of Nigeria, who have had no hand in all of these.

If it took you this long to admit lawan's case was all a falsehood. A day will come you will also admit BAT victory was also a falsehood.I don't know when but only time will tell.
