President Goodluck Jonathan has ordered an investigation into the activities of the alleged cabal behind the massive corruption in the fuel importation programme. Coordinating Minister of the Economy and Minister of Finance, Dr. Ngozi Okonjo-Iweala, disclosed this during an interview yesterday on a live television programme in Abuja, adding that the findings of the investigations will soon be made public.na today? The Federal Government had based its decision to end fuel subsidy payment on the need to check the activities of the cabal comprised of government officials and businessmen that had resulted in the fuel subsidy regime spiraling out of control to be come an all comer's pot of porridge.

Fuel importers had received close to N3.7trn in subsidy payments between 2006 and 2011. In 2011 alone the fuel importers received about N1.4trn, due to what the government said was the increase in global oil prices and huge arrears due to the Nigerian National Petroleum Corporation, NNPC, for household kerosene imports. However, stakeholders have questioned how the subsidy payments rose from N261bn in 2006 to N673bn in 2010 and have accused government of grave failings in managing the petroleum products supply and distribution chain. The fuel subsidy regime was created to keep fuel prices low by the government paying the differences between market price and pump prices to fuel importers but quickly become an avenue for well-connected businessmen to make billions of naira for doing virtually nothing.

Even some genuine fuel importers creamed off huge profits by importing quantities much lower than that quoted on Letters of Credit. In December last year, the Joint Senate Committee on Petroleum Downstream, Finance and Appropriation named dozens of companies including construction firms that had benefitted from the fuel subsidy scheme and had collected N1.42trn between January and August alone. Some of the major actors named include Oando Plc, which got N228.5bn; MRS (N224.8bn); Pinnacle Construction (N300bn); AP (N104.5bn); Folawiyo Oil (N113.3bn); Obat (N85bn); Conoil (N37.9bn); Atio Oil (N64.4bn); Acorn (N24.1bn); Capital Oil (N22.4bn) Enak Oil & Gas (N19.6bn) and Honeywell (N12.2bn). Others are; Integrated Oil and Gas, owned by former Minister of the Interior, Captain Emmanuel Iheancho (N30.7bn) AZ Oil (N18.613bn); Emac Oil (N19.2bn); D. Jones Oil (N14.8bn); AMP (N11.4bn); IPMAN Investment Limited (N10.9bn); Forte Oil (N8.5bn); Bovas & Co. Nig. Ltd. (N5.6bn); Eterna Oil (N5. 57bn); Dozil Oil (N3.37bn) and Frado International (N2.63bn) Some other beneficiaries include A.A. Rano (N1.14bn); A.S.B (N3.16bn); Aminu Resources (N2.3bn); Avante Guard (N1.14bn); Avido (N3.64bn); Boffas and Company (N3.67bn); and Brilla Energy (N960.3m); Downstream Energy (N789.6m); First Deepwater Oil (N257.3) and Heden Petroleum (N693m).

A leaked United States diplomatic cable had suggested that MRS, Total and Oando were the only three officially listed beneficiaries of the fuel subsidy recognised by the Federal Government in 2006 beer parlour rumour!!. The following year, AP, Mobil Oil and NIPCO, a trading company formed by the independent petroleum marketers were added to the list of majors while two other firms, which did not own depots - Aiteo Energy Resources and Triquest Energy - were also brought in to bring the number of beneficiaries to eight. The gravy train got busier in 2008 with the total number of beneficiaries rising to 23 including notable firms such as Conoil, Capital Oil, Folawiyo Energy, Integrated Oil and Gas and Rahamaniyya joining the list.

While some of the petroleum importers have defended themselves saying that they were businesses rendering a service to the NNPC according to agreed terms, industry analyst say the lack of transparency in the entire system had given rise to a situation where importers could make subsidy claims for products not imported or over state import volumes and still get paid subsidies resulting in huge losses to the government. In some cases importers brought in fuel bought from the NNPC back to Lagos port as  imported fuel and still got subsidy payments. Senior Special Adviser to the President on Maritime Services, Mr. Leke Oyewole, told the National Mirror last week that about 43.23 million metric tonnes of imported refined petroleum products valued at N5.63trn shipped to Nigeria were unaccounted for last year.

This information is based on a United States Energy Information and Administration Agency report that a total of 59.23 million metric tonnes of refined petroleum products were shipped into the country between January and December 2011 yet only 16 million metric tonnes were captured in the nation's shipping statistics. i thought the gej muppets said it was smuggling? Governor of the Central Bank of Nigeria, Mallam Lamido Sanusi, had said in a recent article that the scam in the fuel import and subsidy regime could not be stopped because all the control mechanisms had been compromised. He explained that by establishing Letters of Credit for fuel importation under the subsidy regime, importers could easily bribe customs and obtain certification overstating the volume of imports and divert fuel to neighbouring countries. He said it was also possible to get papers certifying that importation was done without a single litre being shipped and still get subsidy payments.

He said the profit margins in the trade were so high that it was possible to buy off anybody and it was difficult to prove the fraudulent acts in a court of law since they transaction were covered by the relevant paperwork. However, some analysts have said the government should have gone after the fraudsters instead of removing fuel subsidy and visit more hardships on Nigerians. However, there are doubts that this can happen as the key players in the fuel import business are the major financial pillars of the politicians in power. can someone say otedola? Meanwhile, the Senate yesterday pledged to use its legislative powers to go after oil subsidy cabal in the country, Senate President David Mark disclosed this at the plenary session.

Marketers Kick over Fuel Import Contracts

Major and independent petroleum marketers have petitioned the Presidency, demanding a review of the third quarter allocation of fuel import contracts which was allegedly carried out secretly.

They alleged lack of transparency in the manner the Petroleum Products Pricing and Regulatory Agency (PPPRA) handled the second and third quarter allocations.

The aggrieved marketers want the presidency to compel the agency to make public, details of the companies that benefited from the allocations; their installed capacities, quantity of products applied for and quantity approved.

Also, the date of importation, port of discharge, vessel name, quantity imported, Naval/ Department of Petroleum Resources (DPR) clearance of such vessel, country of origin as well as names of the promoters of such companies should be made public, they demanded.


The oil dealers who further alleged manipulation in the manner the PPPRA handles administration of the newly introduced Sovereign Debt Instrument (SDI) said that the federal government, in the last few months, has paid out billions of naira to ‘brief case companies’ as imports subsidy on the recommendations of the PPPRA.
They have vowed that should the government fail to address the issue, they may be compelled to resort to other means to seek redress.


The petition written by the marketers noted that “in the second and third quarters specifically, some companies were allocated petroleum products import permit above their request and/or installed capacity, some got allocation below their request and installed capacity while others with well established structures for supply and distribution got nothing at all.

“In the interest of fair-play and transparency, we demand from PPPRA a publication of the full list of those companies which got petroleum products allocation in the second and third quarters along with their installed capacities, quantity applied for, quantity approved, date of importation, port of discharge, vessel name, quantity imported, Naval/DPR clearance of such vessel, country of origin as well as names of the promoters of such companies.

“We also demand that the current third quarter allocation which the PPPRA and its cohorts have secretly carried out be reviewed, the agency should equally give reason for not making the third quarter allocation public, otherwise, we shall be compelled to resort to other measures to seek redress."

The marketers alleged that the PPPRA leadership is flouting government policy by continuously favouring non-core investors in the allocation of products.

“We have borrowed and invested billions of naira to create employment and grow local capacity in the Nigerian economy through construction of tank-farms, filling stations, petroleum tankers as well as acquired ships and jetties, yet we are being denied allocation," said another marketer.

The marketers also noted that they are currently faced with a myriad of challenges including a huge debt overhang occasioned by the collapse in oil prices which hit the international market two years ago; the global economic downturn and its impact on the Nigerian economy and the current banking reforms.

“We are doing our best to cope with these challenges of huge debt overhang due to declining oil prices and shall not sit back and watch helplessly while misguided elements undermine government’s good intentions for the growth and development of the industry.

“Clearly, the recent passage into law of the Nigerian Content Bill underscores in more eloquent terms government’s good intentions. However, the second and third quarter allocation is obviously at variance with the aspirations of government to grow indigenous capacity,” the marketers stated in their petition.

Under the guidelines of the Petroleum Subsidy Fund, only companies that are registered as oil marketing companies with the Corporate Affairs Commission; those with proof of ownership of storage facilities of 5,000 MT for a particular product as well as dispensing facilities (retail outlet network); and companies with the ability to finance a minimum cargo of 5,000 MT of product, are eligible to draw from the fund.

But the PPPRA with the support of the ministry has been circumventing the criteria for a long time, enabling ineligible companies to make claims for products they often do not import.

THISDAY investigations revealed that in the third quarter, African Petroleum, MRS and Oando were allocated 180,000 Metric Tonnes (MT) each. Also, a company identified as SPOG Energy was allocated 210,000 MT, Pinnacle and Zenon Petroleum, 60,000, each, while Masters Energy and Capital Oil and were allocated 15,000MT each.

In the 2nd quarter, most of the companies listed by the PPPRA were unknown companies in the oil and gas industry. They included Alminur Resources Ltd, Annajul, ASB Investment Company Ltd, Delmar Petroleum Company Ltd, Knights Bridge Ltd, Lloyds Energy Ltd, Majope Investment Ltd, Menol Limited, Pinnacle Oil and Gas Ltd, Rosari Ltd, SEDEC Energy Ltd, Sirus Taglient Petro Ltd and Stonebridge Oil Ltd.

In the 2nd quarter allocations, Folawiyo Energy Ltd requested for 360,000 MT but saw its allocation reduced to 150,000 MT; Mobil Oil Nigeria Plc asked for 90,000 MT but was given 30,000 MT to import; Rahamaniyya Oil & Gas Ltd was slashed from 180,000 MT to 60,000 MT; Sahara Energy Resources was cut from 350,000 MT to 60,000 MT; and Honeywell Oil & Gas Limited from 90,000 MT to 15,000 MT.

Others companies, which had their requests slashed include: MRS Oil & Gas Ltd - 480,000 MT to 90,000 MT; Total Oil Plc - 60,000 MT to 30,000 MT; Acorn Petroleum Plc - 120,000 MT to 15,000 MT; Conoil Plc 120,000 MT to 60,000 MT; Integrated Oil & Gas Ltd - 90,000 MT to 15,000 MT; IPMAN Investment Limited - 90,000 to 30,000 MT; NIPCO Plc - 60,000 MT to 30,000 MT; and Masters Energy - 180,000 MT to 30,000 MT.


Reacting to the allegation that the PPPRA and the Ministry of Petroleum is doing everything possible to ensure that the third quarter import allocation schedule does not get into the public domain, the Petroleum Minister Mrs. Diezani Alison-Madueke distanced herself from allegations that she interfers in the daily operations of the PPPRA.

Speaking through the General Manager Group Public Affairs Division at the Nigerian National Petroleum Corporation (NNPC) Dr. Levi Ajuonuma, the minister said the allegations were baseless, given that the agency is not administratively within her direct supervision.

She added that the PPPRA is under the presidency and does not report to her. “Any insinuation to the effect that the minister interferes with the day-to-day running of either PPMC or the PPPRA is not only unfair, but a blackmail which will not be tolerated,” Levi stated.


Also, a PPPRA source who spoke on condition of anonymity last night dismissed the allegations and insisted that the agency has been transparent in the handling of products allocation.
He explained that the agency allocates products to entities in accordance with the Petroleum Subsidy Fund (PSF) guidelines, which provides that only registered companies with proof of ownership of storage facilities of 5,000 MT or entities that have confirmed through-put arrangement with other companies are entitled to the products allocation.

He said about 50 companies applied for allocation, a number, which the agency viewed as too much. The source also denied the alleged manipulation of the SDI, saying it comes directly from the Debt Management Office (DMO). He explained that some marketers submitted their bids very late, but that 35 marketers who were qualified for the third quarter benefitted.

The scam is breathtaking in its brazenness: in exchange for obtaining the authorisation to import gasoline, oil marketers are being instructed by an agency in the petroleum industry to call a mobile telephone number and pay a bribe of $8 per metric tonne of petroleum allocated to them. This single scam, which was imposed just last week on oil marketers such as Conoil, Total, Sahara, Oando, African Petroleum, Mobil and the rest of the 36-member field, involves the 1.8 million tonnes of refined petroleum approved for importation for the April to June quarter by Diezani Allison-Madueke, the petroleum minister. Each marketer is scheduled to import between 50,000 and 180,000 tonnes for the quarter, industry and government sources said. By these numbers, each company is liable to pay between $400,000 and $1.44 million, or a total of $14.4 million.

The agency at the heart of this particular scandal is the Petroleum Products Pricing Regulatory Agency, or PPPRA, which is in charge of government subsidies to keep gasoline prices low. The agency issues letters of authorisation that allow oil marketers to import gasoline and other subsidised products. The agency, like the Petroleum Development Trust Fund, has customarily operated under the supervision of the presidency. But upon being named minister a year ago, Mrs. Allison-Madueke fought to consolidate the agencies under her direct control, including throwing a tantrum during a cabinet meeting at which the president finally gave her what she desired, according to those at the meeting. After taking control of the PPRA, the minister appointed a trusted pal, an NNPC official close to retirement, Godi Ebugi, as the agency’s executive secretary. It is believed that Mr. Ebugi is at the agency to do the minister’s bidding.

Helping the boss

According to multiple sources in the oil industry and at the highest reaches of our government, Mrs. Allison-Madueke has let it be known that this and other back-channel payments are required in part to fund the election campaign of her boss, President Goodluck Jonathan.

“This ‘small toll’, we are told, is to finance the president’s re-election campaign,” a well-placed source from one of the affected oil marketers told us.

There are no genuine ones amongst them. They are all in it. Like saying there are government contractors who don't kick back. Name them. Power, roads, etc. Even when they are owned by government officials they percentage out. Genuine businessmen steer clear of government and its businesses. That's why this government action is different. That's why this strike action is different. No one will come out unscathed. Reputations will be damaged irreparably among some government officials, members of labour and the participatory private sector. These are the groups that have worked hand in glove to bring Nigeria to its knees.

Reacting to the allegation that the PPPRA and the Ministry of Petroleum is doing everything possible to ensure that the third quarter import allocation schedule does not get into the public domain, the Petroleum Minister Mrs. Diezani Alison-Madueke distanced herself from allegations that she interfers in the daily operations of the PPPRA.

Speaking through the General Manager Group Public Affairs Division at the Nigerian National Petroleum Corporation (NNPC) Dr. Levi Ajuonuma, the minister said the allegations were baseless, given that the agency is not administratively within her direct supervision.

She added that the PPPRA is under the presidency and does not report to her. “Any insinuation to the effect that the minister interferes with the day-to-day running of either PPMC or the PPPRA is not only unfair, but a blackmail which will not be tolerated,” Levi stated.

Also, a PPPRA source who spoke on condition of anonymity last night dismissed the allegations and insisted that the agency has been transparent in the handling of products allocation.
He explained that the agency allocates products to entities in accordance with the Petroleum Subsidy Fund (PSF) guidelines, which provides that only registered companies with proof of ownership of storage facilities of 5,000 MT or entities that have confirmed through-put arrangement with other companies are entitled to the products allocation.

He said about 50 companies applied for allocation, a number, which the agency viewed as too much.  The source also denied the alleged manipulation of the SDI, saying it comes directly from the Debt Management Office (DMO). He explained that some marketers submitted their bids very late, but that 35 marketers who were qualified for the third quarter benefitted.

I just checked the website of one of the mentioned paper companies and guess what, It looks like a paper company.
http://www.delmarpetroleum.com. This is hurriedly crafted site that no respectable eatery would be caught dead with, there is more than the smell of a rat here my friends.

This however does not absolve the subsidized importers, it only implicates the govt further.
