ENUGU—TWO motorcyclists in Enugu State were Thursday sentenced to one year imprisonment each without option of fine for violating the new law banning the operation of motorcycles in the state capital.

Those convicted by an Enugu Magistrate Court presided over by Mrs Ebele Udeze after pleading guilty of the offence were Friday Ucha and Jonathan Eneje.

But, another accused person, Gabriel Ogbonna who was also arrested by the police yesterday for the same offence pleaded not guilty and was granted bail in the sum of N100,000 and a surety who must be a civil servant of not less than Grade Level 16 among other conditions.

The prosecuting police officer, ASP Oluji Clement had told the court that the two convicts were arrested with one Gabriel Ogbonna, near Nowas Filling Station, Enugu for allegedly violating the law banning the opreations of motorcycles in Enugu metropolis.

None of the accused persons were represented by their defece counsel during the trial. The state police command commenced full implementation of the motorcycle prohibition law yesterday during which the three violators were apprehended.

The convicts were taken to Enugu Prisons where they would serve the jail term while their motorcycles were impounded by the police.

Reports said more violators were arrested and detained by some police divisions within the three metropolitan councils of Enugu East, Enugu North and Enugu South, even as it was learnt that more violators might be arraigned in court today.

You must be tripping...

OKADA RIDERS MOTTO: We dont die, we multiply or reincarnate.

Straight jailing them is the only way forward.. They need to know that this is not up for negotiations..Go and find out from Rivers State, Akwa Ibom, Cross Rivers the fight they had to overcome before removing Okada.. Those guys feel invincible and above the law..

Good one Sullivan.. Zero tolerance

Like i said in another thread, the motocycle riders should have been given some time to find a means of livelihood but since the Enugu government have made up their mind then everybody should abide by the new rules. if you violate it, then you go to jail. And i like the fact that there's no option for fine. The gesture should also be extended to other crimes, so that people won't think that they can get away with anything. the only way we can salvage this country is if we introduce severe punishment for offenders.

Some laws may be unpopular but enforcing them must be tough and gives no room for sacred cows to emerge. If the law is seen to be unjust then it can be changed by legislation. Thank you Enugu State. Kindly relay this message to Jona about the corruption in high places. How many thousand times do we need to tell him to act?

Yup!!

Farming!!

Go the fhuck into a rural community and farm!!

When you go abroad into metropolitan cities, Motorcycles are not a means of transportation (except maybe China)..

These Okada riders constitute a nuisance and a raod harzard at the same time.

They break all breakable traffic rules with impunity..

Take so many unnecessary risks..

Cause damage to the vehicles of motorists on a daily basis.. [most cars that have no side mirrors are due to Okada riders]

Visit the teaching/General Hospitals of most states, they actually have a ward dedicated to Okada accident victims..

Most robberies within the cities are perpetuated by men using Motorbikes because of its manuverabilty through traffic and the ease with which it cant fit through tight spaces..

All the states where Okadas have been banned have all registered lower small crimes rate.. [where small crimes are robberies, pick pocketing, Bag snatching and even broad day robberies].

The same way these Okada riders got into this trade, thats the same way they would find another.. Okada is not the only means of survival that exists in Nigeria.. We cannot be held hostage by Okada men..

Kudos to Enugu State Government.. Should they resist, bring in the MOPOL and ARMY and issue them a Kill order..

Our people should learn how to respect the law. It was announced before hand. So let them face the law so that others that are about breaking the law will learn.

It is high time we do things right.

That is one problem with Nigerians!
Every time the authorities talk of banning Okada,
people always site the issue of joblessness as a reason
why okada should continue in our major cities!!!
I bet you, if you come to Warri, you will see the level
of havoc these people have caused...the General Hospitals in
Warri and Ekpan are always filled with wounded persons that had Okada
accident; not to talk of the dead. These people bash people's cars and run away,
they create all manner of traffic on the major roads...some even ride their bikes
through people's stalls in the markets just to get to their destinations on time!
we are just making it look as if Okada is the only source of livelihood for the masses!!!

This is the height of wickedness, 14 days with the option of 15000 fine would be ok.

I agree; 1 year with no option of fine is rather drastic.

Meaning?!

Everyday I see people break the law and walk away because of this useless option of fine or 'Bribery'.. You see a Man driving an Infinity QX55 that you would think would have some measure of respect for the law and himself driving against traffic in broad Daylight because he has some scrunny Mobile Police sitted in from.. Or an Expartaite being driven and escorted by Mopols breaking the law and looking good doing it.. Do you think an option of fine would faze him?! He makes 200000 naira or more per day..

Solution is Mobile Court.. Punishment is 1 year without an option of a fine or Parole.. By the Time Nigerians start seeing ex-convict on their police report, and it hampers them from going abroad or securing a Visa, people will straighten up..

We have broken the law so much in this country that we now have zero regard for it... If it isnt outright Murder, you are free to break it..

Extreme problems require extreme solutions.

We're saying the same thing. I was attacking otoxx's view that they should be given an option for fine which is unnaceptable for me. Stringent measures should be put in place to serve as a deterrent for the breaking of law and order.

Its a shame how within 72hrs a bill went through all the necessary readings in the State House of Assembly, got the Governors accent and 2 convictions. Not to even mention that the convicts where not represented by an Attorney.

If this is our idea of moving our country forward then we surely need help.

So lets look at the 'legal' aspect of this situation.

It seems the people in question were tried without jury and found guilty by some lowly magistrate.

Were they legally represented?

Are they not entitled by a trial by jury where the decision as to whther they've commited a crime is decided by independent persons?

And do they not have the right to appaeal the decison.

The 'Act' that was passed by the Enugu House of assembly goes against human right laws.

And an 'Act' is not a 'Law'!! Its only given the force of law if consented by the accussed!

It is a fundamental 'human right' that all persons have a right to earn a living!

How can a law passed in Enugu surpass 'Human Right Laws'?

To me this is jungle justice - the so called lawmakers have no understanding of law.(they are made up of mechanics, thugs and drop-outs)

If I were in Nigeria right now I would represent those jailed as it would appear they have been 'unlawfully' arrested and convicted of a crime thats not a crime - namely earning an income by provding a service people have demanded.

An appeal should be lodged and a competent lawyer should deal with these 'backward' lawmakers.

Yes dats a great law and i hope fashola follows suit in lagos.disorder, chaos and extreme lawlessness has now become a way of life in major cities and okada men are d major culprits, they over speed despite warnings, deliberatly ignore people crossing d road even if it means driving over their feets to pass, they even drive so roughly on peadestrian roads without regard 4 people walking, dey horn, push, yel and behave so uncivil.if u notice many places in lagos were okadas r nt allowed are less chaotic n lawless.look at closes in festac e.g i close in festac, okadas are not allowed, since when dey stopped okada from entering, there was less stealing.drastic situations calls for drastic measures.even in ife too, since okada was banned in staff quartes,d rate of stealing reduces drasticaly.if u want to cross wahala,if ure even standin @ d bustop okasa will run into u and hit u if ure nt careful

Isn't this a bit harsh? I am not saying that people that disobey the law should not be punished. But i am sure that if half the people in government, who are stealing us blind are handed this kind of punishment, then many Nigerians would go for thanksgiving in their various places of worship! Haba Judge!!! What is good for the goosey goosey is good for the gander nau!

This is stup1d. Have they opened new jobs for the okada drivers, which then give them the right to ban okada driving? mschwee
I guess they want people to die before our politicians start thinking with their brain rather than their @ss.
