Nigerians living in Germany please I need your advice by Babanla2356: 6:07pm On Jul 13, 2023
Hello everyone, I am a Nigerian who was studying in Ukraine before the war broke out. I left Nigeria on the 5th of January 2022 and I applied for my temporary residence permit (povidska) in Ukraine before the war started in which the immigration authority gave me a proof that I applied. So after the invasion I left Ukraine and headed to Germany when I arrived in Germany I contacted the immigration authority and tell them about my case that I am a Nigerian national studying in Ukraine I submitted all the Ukrainian documents I have with me and applied for a residence permit after a month I got a response from them that my application has been accepted and I should come to their office, when I got there I was issued a fictional certificate (Fiktionbeschenigung) which was only valid for 6 months. After then the district started paying for my house rents, health insurance, enrolled me in a language school and I was receiving social benefits.
A month before my fictional certificate expires I received a letter from the foreign authority that I should go back to Nigeria that longer protection is only for Ukrainian citizens that Nigeria is a safe country. I told them that I would like to continue my studies in Germany and I send them the paperworks of the language school I’m currently attending and they still insisted that is not a proof not to go back to Nigeria and they rejected my residence permit application, they stopped all the social benefits I was receiving and they gave me a month to appeal the decision at the court which I did. Learning the language was so easy for me because I attend the school everyday and I will get my B1 certificate this July and I also have an apprenticeship position right now as a Plant mechanic for heating and plumbing and I have received the apprenticeship contract. I sent the contract to the foreign authority they still said no that I have to return to Nigeria and I apply for an apprenticeship visa in Nigeria but the case is still at the court but I don’t know when the court is gonna decide because it’s getting late, the apprenticeship starts in August. I wanna ask if there is anyone that has been in this situation before or any Nigerians here living in Germany that know how the system works that can advice me on what to do.

I am imagining how tensed you are right now.

Get in touch with different Nigerian communities around you and know what they can suggest, you should also seek out an immigration lawyer especially one who has a migrant background.

Thanks for your concern, I just hired a lawyer last month and he has already started working on the case, I didn’t want to hire an attorney at first because my teachers at school and my German neighbor were helping me since January when my application was rejected and they tried their possible best but it’s me against the government, so they suggested I should hire an expert. I wanna know if there’s any other way so that I can start my apprenticeship this August

What they did was simply took the load(you) off their shoulders.

They were helping Ukraine refugees with basic needs of life and included you, a citizen of another country temporarily until you could find your way back to your country and six months should be enough for that, in their opinion.

It's a fair deal if you ask me so hiring an attorney against the country's immigration will definitely complicate your issue.

For them to help you for six months means they checked you out and found out you had clean records in Ukraine.

Getting German visa wouldn't have been difficult for you if you had thanked them for their help and agreed to return to Nigeria.

You would then apply for their visa to continue your education in the country.

If the attorney you hired fails, you may have ruined your chances of ever getting into Germany again. Not just you but your family members who bear same last name if your last name easily stand out.

JefferyJunior has said it all. It will be advisable to come back and apply for German visa from Nigeria since you have all documents for the apprenticeship position you are hoping to start in August instead of biting the finger that fed you as a refugee from Ukraine war. Most Nigerian students in Ukraine were send back to nigeria at the peak of the war and you were lucky to join Ukrainers to German refugees camp.

Hypothetically, I believe that if you claimed you were LGBTQ and your life were threatened in Nigeria because of your gender confusion, then they will have to give you refugee status.
What is trans: basically a man who claims to be a woman or a woman who claims to be a man.

"Directive 2001/55/EC" (Link to the act below) is the legal basis of your residence in Germany as someone needing temporary protection.

As far as I can understand from the act, there is no way you can retain your residence in Germany continuously, as it was not intended for that.

Like someone adviced, you'll either have to go a neutral country where you have a right of residence, so in your case, Nigeria, or Ukraine (assuming the war stops) and apply to come back to Germany,

Or if you really wants to stay back in Europe without going to Nigeria, then apply for a residence permit (maybe on the basis of studies) to another EU country, so your residence in the new country would not be temporary in nature, like Germany.

You can apply for a visa/residence permit from your country of legal residence, which for you, it's Germany. So get a study place in maybe Poland, then go study there. That's how you can stay back in the EU without going back to Nigeria.

But it might be too late now, because if your residence in Germany have been terminated and undergoing appeal, it will be difficult to proof to the Polish embassy that you're still a legal resident.

If you also hold Ukrainian citizenship, or married to a Ukrainian, then you could stay longer, but since Nigeria is not at war, the immigration office are within the scope of the law, to terminate your residence, for you to go back home.

I'll advice you don't waste money on lawyers. Lawyers knows you won't get it, they will just collect your case, give you false hope and eat your money.

You'll also earn yourself a shadow ban, meaning, they won't tell you, but getting a visa would be very difficult for you in the future.

Only use a lawyer to buy time (eg to save up, finish up a course, etc), since by law, you can remain in the country when your case is undergoing an administrative redress.

Bro find a way to get a student or work visa to Poland, Spain, Portugal, Italy or France, Germany is not an immigration friendly country especially for asylum seekers, they just deported some nigerians on a charter flight back to naija last week.

U can't generalize , everyone has his or her own way of behavior, in Nigeria some people are good to you while others are not . Some will say Ukraine is good some will say otherwise. In my opinion all white country without a majority of blacks will definitely have racist behavior. Even ones with huge number of blacks like USA still have racists.

So sorry about the situation that you are in, since you have an apprenticeship that's starting soon, is it possible for them to file for a work permit for you? I'd say you should try all possible options to remain in the EU, getting a visa from Nigeria is tough due to the backlogs
