What rights does the Nigeria Police have to prosecute suspect in court?

Well, that is well settled. The Supreme Court settled the matter in the case of Federal Republic of Nigeria V Osahon which is reported in part 973 in 5 NWLR 2006 at page 361. The Supreme Court interpreted the provision of Section 23 of the Police Act which gives the police power to prosecute. It says a police officer may conduct prosecution in any court whether or not the information or complaint is laid in his name. In that case the Supreme Court reverse the Court of appeal. So what you have is that generally, police has the right to prosecute before any court of law. And then they can take their case up to Supreme Court.

Now what is left is for that right that is subject to the overriding power of the Attorney general to take over any prosecution. Either to discontinue or continue. And I think sometimes, that is what the Attorney general use to control the power of police. Sometimes he asks the police to send files to him and then takes over the matter the police is investigating or prosecuting. He can take deliberate steps to stop the police like what happened in Portharourt Rivers State where the Attorney general asked for the file of a case of one of the House of Assembly men being prosecuted by the police and the police refused. The next thing is Attorney general went to court and enters the nolle prosequi (terminating the case). So police can prosecute, but the Attorney General both at the state of federal level have overriding power to discontinue a case.

You are partially correct to the extent that while they have the constitutional power, they can be overridden by the Attorney General of a state or the federation =>



My point on this thread remains VALID, to wit; the state House of Assembly has adequate authority to order an independent investigation that will form the basis of an impeachment process.

Shouting EFCC, ICPC etc is a cop out that we must not allow for our elected public servants at the state level to get away with any longer.

Bros, I have seen LG Budgets specially in Lagos State. I haven't seen any Rivers LG budget though but I won't find it difficult to get such information if need be. I call it a fraud not because Wike says so but ythe explanation of Madam Amaechi tallies with what PDP members are saying. They won't investigate/Prosecute because they are all beds of a feather.
