Whatever happens, I expect the National assembly to demand that the IGP resign or be relieved of his appointment

Schematics:
This is a right move.

Is he still the speaker of the House? NO

He got Speaker's post because PDP was and is still the majority in the House. Now that he has pitched his tent with APC which has minority in the House, the right thing to do is to relinquish his position immediately he decamped.

I don't know why some people want to create unnecessary attention.

You can't eat your 'gworo kola' and have it back!
tell me why mimiko nd yuguda doing in governors seat cos dey defect to PDP ryt so if u in PDP u r above d law ryt u b mumu

Bros is Tambuwal still ba member of the HOR? That is the fundamental question u should try and answer

Naira is in freefall to N174 to $1 today.
And we're the biggest economy in Africa.

Price of crude oil is in freefall at $75.
And this government is still borrowing.

Boko Haram is increasingly emboldened, capturing Nigerian territories.
And there has been a state of emergency since a year with billions spent/wasted.

Electricity is still at a low 3,000MW today.
And Jonadum lies about transformation.

Police is still killing people without challenge.
And government keeps lying.

Our federal roads are eyesores.
And Jonathan lies about transformation.

Our agriculture is still comatose.
And pdp has been in government since 1999.

Our military is being disgraced by a ragtag group under jonathan.
And jonathan spends billions in dollars.

Where's is jonathan's achievement?

Goodluck jonathan keeps reducing his 2015 votes everyday by himself.

Very unpopular and crude man.
Con, skill, intelligence, tactics, strategy is far from him.

Is Mimiko still Governor of Ondo State? YES.

Warped minds.

I keep seeing this comparison with Mimiko. Get this straight: Mimiko is a governor and Tambuwal is a member of the House of Reps, these are different positions! The Constitution provides specifically that a member of the House of Reps loses his seat if he becomes a member of another political party. (Section 68(g) of the 1999 Constitution).This section is crystal clear. Stop calling Mimiko who is a governor. The section does not apply to governors!

Thank you. I wonder how some people reason. You just hit the nail on the head and only those who who read books upside down and reason the same way will still be making such comparison. The conditions of a Governor is different frm an assembly member

Since folks have been too lazy to dig up stuff for themselves, here is the part of the Constitution of the FRN that pertains to the Tambuwal scenario

Chapter V
The Legislature
Part I

National Assembly

68. (1) A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -
(a) he becomes a member of another legislative house.

(b) any other circumstances arise that, if he were not a member of the Senate or the House of Representatives, would cause him to be disqualified for election as a member;

(c) he ceases to be a citizen of Nigeria;

(d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.

(e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.

(f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;

(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected;

Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or

(h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.

Now, the question is "Is PDP divided?" Remember that in the nPDP vs PDP scenario, a previous court ruling had ruled that PDP was not divided.

Tambuwal's best bet would been to allow the court explicitly state his case (even though its clear from above) AND not try to preside over the HOR. He pushed his luck too far...

For those that are interested below is the url for Constitution of the FRN

http://www.nigeria-law.org/ConstitutionOfTheFederalRepublicOfNigeria.htm#QualificationForMembershipOfNatAss

Hey, you cannot quote Sub-Section 68(1)(a)-(h) without quoting Sub-Section 68(2) which gives action/power to 68(1)(a)-(h);

68(2) The President of the Senate or the Speaker of the House of Representatives, as the case may be, shall give effect to the provisions of subsection (1) of this section, so however that the President of the Senate or the Speaker of the House of Representatives or a member shall first present evidence satisfactory to the House concerned that any of the provisions of that subsection has become applicable in respect of that member.

Now according to 68(2), it is NOT you, me, the police, the President that has the constitutional power to give effect to subsection 68(1), it is the SPEAKER (in the case of HOA) that has the constitutional right to give effect provided there is a SATISFACTORY EVIDENCE.

subsection 68(1) is not automatic.

The constitution is clear.

Those men jumping over the gate locked by the tyrant Field Marshall Idi amin dictator jonacrazy did the right thing.

That assembly was not built by jonadictator.It was built for all Nigerians, it belongs to the men jumping over it,they should jump again anytime there's an attempt to stop them from entering it the right way.

I CALL ON ALL NIGERIAN HEROES,MOVE FORWARD,GO,JUMP,CLIMB THE GATE, EVEN THE FENCE OF THE NATIONAL ASSEMBLY;IT BELONGS TO YOU.

Some 1000 soldiers and policemen have sealed the entrance of the National Assembly in Abuja and physically prevented the Speaker of the House from entering.

Sahara Reporters Media

 The Speaker of the House, Aminu Tambuwal arrived the National Assembly today with a view to preside over the sitting of the House but fierce looking troops posted the stopped him at the gate. A melee has ensued as a result.
 Mr. Tambuwal, President Goodluck Jonathan and the ruling People’s Democratic Party are at loggerheads over the Speaker’s decision to decamp to the All Progressives Congress (APC) a few weeks ago.

Immediately he joined the APC his personal security guards were withdrawn on the orders of the President.

Double standard on the part of anyone commending this move by the clueless president, the last time i checked Mimiko is still the Governor of Ondo state, didn't he cross from LP to PDP? And Nigeria Army is a shame and a disgrace there only job is to harass innocent civilians.

And pictures of those lawmakers climbing through the gate really got me laughing real hard.
