The Nigerian Court ruled as far back as 1961 in Aoko Vs. Fagbemi that adultery is not a crime. It is only criminal under the Sharia Law and Penal Code that operate only in the Northern parts of Nigeria. This is basic to every Law student or Lawyer.

Adultery is a crime only in states that use the penal code, mostly Northern states.



However Section 6 of the Criminal Code of the Federation stipulates that unlawful carnal knowledge is a crime. Unlawful carnal knowledge is sex between unmarried couples. We can infer from there that the sexual intercourse between unmarried lovers, even the one between you and your boyfriend/girlfriend is a crime.
