The question then is, are his parents staying in the house as well or did the husband inherit the house from his parents? Thats the part that was not clearly enumerated. Be that as it may, if the house was inherited by the husband and that became their marital home, courts usually let the wife occupy the house if there's any marital issue especially if there are children from the marriage. The simple reason being that courts do not like to take children out from a home that they have known and gotten used to. Besides, courts believe that the man in this case the husband is usually much more resilient and can find alternative accommodation than the woman (wife).

However, if there are no children, she can still occupy the house depending on the facts of the case during their period of separation. At the moment her staying in the house is most likely as a result of a temporary restraining order (TRO) issued by the court. TRO is an injunction, but it is used in situations in which the plaintiff (wife) needs immediate protection and theoretically cannot afford even the delay required to hold a hearing on the matter. There is no hearing or process required to obtain a TRO; upon the wife's application, the judge can simply issue the TRO. Because the TRO procedure does not give the defendant (husband) much room to contest it, TRO is limited in duration, generally no more than 10 days. Some courts may extend the TRO to 20 days upon a showing of good cause, but after 20 days, the preliminary injunction process must take over. TROs are very difficult to appeal.

The intention of a preliminary injunction is to keep things exactly as they are for long enough to allow the court to make a decision on the underlying issue. In this case, the couple might be fighting over the ownership of the house in which both live. She might apply for a preliminary injunction to keep her husband from selling the house until the court decides who owns it. Preliminary injunctions are not intended, in themselves, to be permanent; however, once the court decides the underlying issue, it may decide to make the injunction permanent.
