The FIFA Emergency Committee decided today, 4 October 2010, to suspend the Nigeria Football Federation (NFF) with immediate effect on account of government interference.

This decision follows the latest events linked to the NFF, such as the court actions against elected members of the NFF Executive Committee preventing them from exercising their functions and duties, the stepping down of the acting NFF General Secretary on the instructions of the National Sports Commission, the decision of the Minister of Sports to have the Nigerian League start without relegation from the previous season, and the fact that the NFF Executive Committee cannot work properly due to this interference.

The suspension will be maintained until the court actions have ceased and the duly elected NFF Executive Committee is able to work without any interference.

During the period of suspension, the NFF will not be able to be represented in any regional, continental or international competitions, including at club level, and also not in friendly matches. In addition, neither the NFF nor any of its members or officials can benefit from any development programme, course, or training from FIFA or CAF while the federation remains suspended.

Journalist Olukayode Thomas Versus Amos "BABATUNDE AREMU" Adamu's Libel Case: How A David Defeated Goliath In A Nigerian Court



BACKGROUND: WHEN the editor of The Guardian Newspapers, Lagos, Nigeria, Debo Adesina assigned me to do an enterprise story on FIFA and CAF executive board member, Amos Adamu, sometime in 2002, I did not know it was the beginning of a long journey that peaked with Adamu suing for libel in 2007 and demanding the sum of N500 million (A little over two million pounds) as damages.
A plethora of petitions had been sent to The Guardian by some Nigerians containing allegations against Adamu, then the executive director of COJA - the body charged with organizing the Abuja 2003 All Africa Games.
Adesina had sent some reporters to investigate the allegations, but they just interviewed Adamu and left it at that.
So, Adesina was very clear about what he wanted me to do.
The investigation took me to Zuru, Kebbi State and Sokoto, Sokoto State where Adamu last lectured before he joined the civil service.
I went to Zaria, Kaduna State; Ife, Osun State and Ibadan, Oyo State - the three states where he schooled. I was also in Ogbomosho, Oyo State; Abuja, the Federal Capital Territory and several parts of Lagos State.

REVELATIONS ABOUT ADAMU
The revelations where mind-boggling. Adamu, a civil servant, owns choice houses in all the nook and crannies of Nigeria; his children attend top Universities in the United Kingdom. He owns hotels, event marketing companies, sports marketing companies and several other business - all controlled by his cronies, children or family members.
But the most startling of all was that Amos Adamu lives with a false identity. I discovered in Zuru, Kebbi State, his place of birth, that his real name is Babatunde Aremu.
Adamu's father is from Ogbomosho, Oyo State and not Zuru.
Armed with all these information, I went to Adamu's office in Abuja. After waiting for three days, Adamu agreed to an interview.
I asked questions about his wealth, properties in all parts of Nigeria, and where he actually comes from and his real name.
Adamu's answers were 'yes,' 'no' and 'no comment'. As I took my leave, Adamu said, ''I won't stop your story, but remember, I have the best lawyers in Nigeria''.

ADAMU'S REACTION
On my way to the airport to board a flight from Abuja to Lagos, Adamu's aides did all they could to persuade me to drop the story. When all failed, they gave up.
Back at The Guardian, the first question Adesina asked was 'who actually is this Amos Adamu? So many prominent Nigerians have called me drop this story''.
When all effort to persuade The Guardian failed, Adamu himself came to The Guardian with about 20 aides.
After speaking for some minutes about how COJA would organize the best All African Games ever, Adamu then started talking about himself and plans by some Nigerians to bring him down.
He told The Guardian editors that one's state of origin was not important as long as one is a Nigerian.
The Guardian assured him of its co-operation and all that.A week after his visit, The Guardian ran the story and thus began the war between Adamu and me.

VOICE FOR THE OPPRESSED AND BLACKMAIL
After the story, many of the oppressed in Nigerian sports and even outside Nigeria, such as former WAFU president Jacque Anuoma started sending me documents.
Overnight I became a voice for the oppressed in sports. To Adamu and his aides, however, I was nothing but a satanic writer.All efforts to compromise or induce me with appointments and monetary incentives failed.
Adamu's resort to blackmail and other tactics also failed.
When all failed, he saw the court as a place where he could silence me.

NFL CRISIS AND COURT CASE
The opportunity came when the leader of Nigeria Football League (NFL), Oyuki Obaseki alleged in 2007 that Adamu was behind the then crisis in the organization because he wanted the sponsorship money handed over to him. Almost at the same time, officials of the Athletics Federation of Nigeria (AFN) made similar allegations against the man.
A large section of the sporting press reported the crisis, while the National Assembly deliberated on it.

ADAMU EMBARRASED, BUT THE GUARDIAN PERSISTS
Adamu found the reports embarrassing, and through bribery and intimidation, he was able to silence a majority of the reporters and sports editors that were reporting the story.
But The Guardian resisted. Adamu told everybody that cared to listen that The Guardian Sports Editor has been paid to destroy him.
When even threats of court action failed to stop my stories, Adamu took me to court. But since the court did not stop me from reporting sports and writing about him, I continued with normal business.

[b]THE ROLE OF MY COLLEAGUE[/b]S
Shortly after he took me to court, we met in Abuja. Though he knows my name, as we talk regularly on phone, after our first meeting in his office in 2002, I didn't see Adamu again.
He saw me on couple of occasions, but he could not recognize me.There was a particular incidence at Abuja Hilton Hotel where he was telling his friends in the media how they removed Ibrahim Galadima as NFF chairman and installed Sanni Lulu, the current NFF chairman.
So a few weeks after he took me to court, I and some of my colleagues met Adamu at a function in Abuja. He came in and greeted all of us. Obviously, he didn't recognize me. But no sooner had he stepped out than two of my colleagues followed him.
He came back almost immediately and walked up to me. "Good afternoon sir. I am Amos Adamu", he introduced himself. Obviously, two of my colleagues who went out with him had told him who I was.
I greeted him, but I didn't introduce myself. When he realized I wasn't going to say a word, he then asked, "Are you Olukayode Thomas"? I said yes. He said, “we are going to meet in court''.
I replied that he is meeting The Guardian in court, not me. But he insisted that it was me. After the meeting, he called me aside and assured me that the matter could be settled. That people are just trying to pull him down and that he is a nice fellow and that we could become friends. He then asked me to come to Abuja at his expense to spend a few days. I told him I would be delighted, that all I need for me to come is for him to write a letter to the editor of The Guardian, Mr. Debo Adesina asking for my release.
When I told him to write The Guardian, he realized that I just told him politely I was not interested.
People familiar with Nigerian media might be surprised by the roles of my colleagues, because ordinarily, Nigerian journalists support their colleagues when they have a case in court.
But majority of my colleagues not only queued behind Adamu, but they urged him to deal with me.
While they could not say it to my face they normally tell my friends that by the time Adamu finishes with me, I will pack my bags and go into exile because my entire life's savings will not be enough to pay the damages.

OUT OF COURT SETTLEMENT
One day Ade Ojeikere, Sports Editor of the Nation Newspaper arranged a meeting between myself and Adamu at his place in Park View Estate, Ikoyi but I declined. Later, Ojeikere called me to his office at The Nation and told me that he had discussed with Adamu and that he agreed to withdraw the case.
Ojeikere also told me of the role Mike Itemuagbor, Adamu's friend, played in persuading Adamu to withdraw the case from court. After a lengthy discussion, Ojeikere called Itemuagbor on phone. They spoke for a few minutes, and then Ojeikere gave me the phone to speak to Itemuagbor.He (Itemuagbor) equally assured me that the case is now a dead issue and that we should avoid situations that could lead to another legal battle in future.

GREATEST MISTAKE
With that assurance, I went to sleep and forgot about the case.
This turned out to be my greatest undoing. Adamu continued with the case. The judge took evidence of his witnesses and himself, without letting us, the accused, know anything.
After the Beijing 2008 Olympic Games, I went on leave. It was while on leave that I got information that a judge was on the verge of ruling on the case in Abuja.
I met Kingsley Osadolor, the legal adviser of The Guardian Newspapers and told him of my shock and surprise, since Adamu had promised to withdraw the case from court.

DRAMA IN COURT
A bigger drama happened in court. I met one lawyer, Tolu, who looked and talked like a gentleman. He was The Guardian's lawyer and he told me he had been on the case for a while, and that he had prepared a statement of defence for me. All I had to do is to tell the judge that the statement was mine.
The first thing that came to my mind was. This is a set up. Beware, it could be part of the ploy organized by Adamu and his men. I had never met this guy before in my life. I said to him, 'If you are representing me, at least you need to talk to me first before you draw up a statement for me.''Secondly, without my consent, a signature, which did not in any way resemble mine, had been appended.
When the judge called me to the witness box, I told him all I knew about the case and that I thought Adamu had withdrawn it from the court.I was shown the statements that Tolu, the lawyer, had appended my signature to. There and then, I told the judge the truth. That I had never met Tolu before that day and that the signature on the statement was not mine Whereas I was in court without legal representation, Adamu was represented by the firm of Adetokunboh Kayode, a Senior Advocate of Nigeria(SAN) - equivalent of the British Queens Counsel.
Two senior lawyers from the chambers were trying to get me to admit that the statement was mine. It was at that point that my mind told me they could probably be playing a game on me.
I pleaded with the judge to allow me get a lawyer to represent me since Tolu could not be my lawyer. The judge, Justice Danjuma, agreed and adjourned the case till January 2009.

LOOKING FOR A LAWYER
Back in Lagos, I started looking for a lawyer that would help me handle the case for minimal fee but I could not find any. Most of the lawyers I contacted presented me with a bill that was clearly beyond my ability to pay.
Incidentally, all the people that provided the documents that were used in writing the stories were not ready give evidence against Adamu in court.With days to the next adjournment turning into hours and I could still not find a sympathetic lawyer, the thought of losing the case became real. But when all hopes seemed lost Blessing Eghagha, a former colleague, suggested we see a lawyer, Abiodun Onidare, who had an office in Maryland, Lagos.
Dark and huge, Onidare's beautiful office and his state of the art cars made me lose hope the more. 'This guy will be very expensive', I thought. But after listening to us for about 10 minutes, Onidare volunteered to represent me for a token. He, however, added that I would be responsible for the filing fees, paperwork, flight to Abuja, hotel accommodation, airport taxi and other sundry expenses.
Because the date for the next adjournment was too close, we agreed to send a lawyer with a letter to Abuja to plead for a new date.
Thus began another round of legal puzzles and several trips to Abuja. For a journalist with lean resources, it was a serious drain on my purse. There was this particular trip that we had to make to Abuja and I could not raise the funds we needed.
I was on the verge of calling the lawyer that all my hopes of raising money was lost, when my Pastor, two friends of Adamu, a lady and a man, whose name I cannot mention, gave me financial assistance.

ADAMU'S REPUTATION AND STUPENDOUS WEALTH
With many refusing to give evidence against Adamu in court, the lawyer had to resort to questioning the source of Adamu's stupendous wealth and his vast business empire as a civil servant to prove that he is corrupt and cannot sue for defamation of character.

LOCAL PRESS
While Onidare continued the battle in court, I told Eghagha that I will use my contacts in the media to take the case to the court of public opinion. Eghagha warned me it would be an exercise in futility as Adamu is powerful enough to ensure the stories are not used in the press.It thought it was a joke, but my attempts to take the case to court of public opinion failed.
All the media houses failed to run the story, only Ojekiere of The Nation used my story.

INTERNATIONAL PRESS.
When I told Andrew Jennings of Transparency in Sports International, he demanded for all the facts of the case, the e-mails and telephone numbers of all the parties. That was all Jennings needed to take the case to the court of public opinion internationally.
From Jennings' website, a US-based internet site (www.saharareporters.com), with special focus on news about Nigeria not only picked the story, they went a step further by digging deeper into Adamu's life, and posting pictures of his mansions, especially the one he lives in at Park View Estates, Lagos and the multi-million naira wedding for his son on their website. They also do regularly updates on the website.

JUDGEMENT
After the judge heard my side of the story, my lawyer called to inform me that the judge would rule March 11 and 12.
The March 11 ruling was for the matter between me and Adamu, and the next days would be on the matter between Adamu, I and the Guardian.In the matter between I and Adamu, Onidare called me in the evening of March 11 to inform me that the judge had granted my prayers, and then the next day, he called to inform me that the judge had dismissed Adamu's case against I and The Guardian.

DAVID DEFEATS GOLIATH
That was how a struggling journalist, who could barely afford the service of a lawyer, defeated a FIFA and CAF executive member who employed the service of a SAN for millions of naira in court.

COUNTING COSTS

There is still a big hole in my pocket as a result of the case. I am still in debt. I still cannot collect the judgment so that I can counter-sue. I still need money for a lot of things, but the innate joy that I have that truth prevailed at the end of the day compensates for all the financial losses and emotional trauma.

Good Morning Ladies and Gentlemen of the Press: I have facts and data that show without any doubt that Mr Femi Otedola has been Milking African Petroleum for his private gains for the past two years.

I wrote several memos and petitions about this as the Finance Director of AP to all the Directors AP, the DG of the Securities and Exchange Commission, The President of the Stock Exchange and the Police and we have received no response. My lawyer has also written a petition to the EFCC on this issue. I am now compelled to come to the public and state the facts, so that if anything should happen to me, everyone will know who is responsible and why. I am not a wealthy man with friends in high places, but I am a professional accountant and I refuse to be a part of falsehood. I am currently being persecuted because I refused to cook the books as requested by Femi Otedola, I also refused to allow Mr Otedola to continue to siphon money out of AP for the benefit of himself and his other companies. AP is quoted on the Nigerian Stock Exchange and the shareholders need to know what s going on!

Now, please let me fill you in with the facts.

Please bear with me that I may not be eloquent, but the facts speak for themselves.
In 2009, African Petroleum plc made a loss of about N15 Billion, this was due to the fact that the Chairman’s companies (Zenon Petroleum and Gas Company Limited, Platinum Fleet Limited and Fineshade Energy limited) started selling products to African Petroleum Plc at Higher prices than normal, at times higher than the retail pump price at gas station.

In September 2009, the Finance Director prepared a management account where the company made a loss of N9.7 Billion. The loss was not acceptable to the chairman who brought in others to produce an alternative account that showed a profit of N957 million. They also suggested that we warehouse N15Billion as un-reconciled inventories and to seek board approval to amortized it over five years. This was not acceptable to me as Finance Director because the causes of loss making were known.
Prior to this time, I have requested that the companies of the Executive Chairman refund the N15B owed or supply the products as this was the cause of the loss.

The Executive Chairman ensured that his companies supplied products to African Petroleum Plc without contract or agreed prices.
As a result of this and many other issues, the chairman was asked to step down as chief executive officer and he did.

[b]The reasons for the losses recorded in 2009 are:

1. The executive Chairman forced African Petroleum Plc to take products from his companies at prices higher than the normal.

2. The Executive Chairman forced the company to pay for products in advance. The amount outstanding as at 31st December 2009 was N10B

3. The loss on Petroleum Products Price Regulatory Authority (PPPRA) rebate on imported products is N32 Billion because the purchase was from       
    the Chairman instead of direct import that would have been more profitable.                                                                           

4. The loss due to Chairman's companies over loaded invoices is approximately N4 Billion.

5. African Petroleum paid rent of N1B for the use of the Zenon house in Victoria Island

6. Mixing up Zenon transactions with Africa petroleum PLC
    a. The Chairman forced the company to use his Tank Farms for storage of African Petroleum's products
    b. As at 31st December 2009 the differences on premium motor spirit (PMS) was 28, 347,742 litres valued at 1.9billion. The Union in AP i.e. 
        NUPENG and PENGASSAN have also demanded the removal of the chairman and the black listing of his companies as suppliers to AP.[/b]

   
As the Executive Director, Finance and IT of African Petroleum, I have queried various transactions and this has led to so many suspensions and various allegations without the right response from the authority concerned at this time we are trying to ensure that our values are restored, considering the fight against corruption.

I have made presentations to the board of African Petroleum PLC on these abuses; I have written memos to the Managing Directors and copied all directors of AP on these abuses.

On the 5th of July 2010, there was a scheduled board meeting of AP Plc; the chairman stormed the venue with 150 armed mobile police men. He entered the lift with too many security operatives thereby overloading the lift. Thereafter the lift got stuck and we got a report from CFAO and the maintenance engineer that clearly stated that there was no foul play.

Instead of following the instructions of the rescuers, Mr Otedola was busy banging his head on the lift door and pressing various buttons (we were told). He came out from the lift and he ordered the Managing Director, Mr. Tunde Falasinnu, the finance director, Mr. Clement Aviomoh and the company secretary Mrs. Elizabeth Idigwe out of the scheduled board room.

He rose from the board room in the evening about 7PM and sent a suspension letter to me and the company secretary; he made the MD to resign.
Someone with the relevant authority and power should please stop Femi from Milking AP dry. Also please help me as I am being persecuted by a rich, powerful and influential man who has done so much harm to the company. Authorities please help before it is too late. Justice delayed may be justice denied!

Former military governor of the state, Air Commodore Idongesit Nkanga (rtd), who also spoke on the issue, apparently because of its destrucitve nature, suggested that since the medium has become a veritable avenue for spin-doctors, the state government should consider opening a liaison office in the UK, for the benefit of those who seek authentic information about the state.
"Idongesit Nkanga" When did this man become a UK resident? It is not sad enough that you spend your time in lobbys awaiting your new master for your Monthly allowance of 500k now your on the entourage to the UK asking questions as if you are UK resident?

The distinguished Professor Dora Dora Nkem Akunyili, Honourable Minister of Information and Communications, distinguished public servant, exemplary regulator, humanist, diligent parent has elected to speak no further word on the shameful cocktail of lies which is being concocted and ghost – written by Professor Chukwuma Charles Soludo in the pen – name of Bonaventure Melah, a phantom and side – kick. The Honourable Professor Akunyili is an African in cultural essence and shares the deep African value for family in its nuclear and extended structures.

She is quite mindful of her role as mother to all within her extended family especially with the recent call to God’s bosom of her elder sister, Dame Gloria Ezenwanne, mother – in – law to Professor Soludo. Instructed and inspired by this cultural standard, the Honourable Professor Akunyili extends her parental instinct to both the wayward and properly comported members of her extended family alike. The prime exemplar of a deviant member of the Minister’s extended family is of course Professor Charles Soludo, a brother – in – law (or in the African sense, a son – in – law) who is at least half a decade younger than her but has elected the shameful and disgraceful cause of abusing her in the media.

Prof. Akunyili is mindful that Charles Soludo lost his mother when he was still formative and therefore did not have the benefit of a proper upbringing and sound moral instruction. She, along with other members of the family, had hoped that bringing him under the family wings will shorn him of the rude edges of his deficient early socialization which, as can be attested to by everyone who knows him, has vested his personality with a rudeness of language, haughtiness of temperament and arrogance of bearing.

Contrary to Soludo’s latest ranting, Prof. Akunyili never aspired to be governor of Anambra State. She did not approach late President Yar’adua or anyone else over any intention to be governor. This allegation is crass fiction and bespeaks of Soludo’s idleness. It is indicative of the uncouth edge to his character formation that our beloved former President who now rests in the bosom of Allah will become the reference for granting dubious affirmation to a false charge. He claims there are “witnesses” to his falsehood. Pray, let him present them; let them step forward.

The truth of the matter is that PDP operates a gender based affirmative principle which grants a waiver from paying for nomination forms to female party members who aspire to elective office. Had the Honouable Professor Akunyili so desired, she could have obtained the nomination forms for the Anambra gubernatorial elections at absolutely no cost. She did not do so because she had no aspiration to be governor. It was Soludo who was so desperate to be governor that he confided in a major stakeholder of the PDP in Anambra who was puzzled at his utter desperation that he, Soludo needed to be governor in order to enjoy immunity from prosecution. This stakeholder, a young man, is still alive and well!
The question then is immunity from what? Most Nigerians are living witnesses to the dubious banking consolidation (is it con – soludo – tion) programme through which Nigerians from all walks of life were made to buy shares in banks under the guise of raising the capitalization of these banks to a baseline =N=25bilion. The money accumulated from this regulator - induced criminality was later shared either in form of unsecured credit or outright looting by players in the banking sector: regulator(s) and operators alike. The bank CEOs, the confederates of this criminal enterprise in the banks, are already being brought to justice but their guardian angel, facilitator - and protector – in - chief, mindful that the day of reckoning may still come, elected to seek refuge in the immunity clause offered the office of governor by the country’s constitution.

Nigerians are still living with the terrible social and sociological consequences of the regulator - induced gangsterism styled con-soludo-tion. It killed off countless family / household economies. It rendered many hopeless and crest fallen. The spiraling criminality in the land including kidnapping is traceable to con-soludo-tion through which countless and hapless Nigerians were beguiled into selling their businesses and investing the proceeds in banking stock. In Igbo land, innumerable industrious and hitherto prosperous young men, rendered prostrate by the unconscionable grand scale fleecing of their life’s savings by the exemplary dubiety called con-soludo-tion, simply keeled over and died; many others have had no option save recourse to violent crime, especially kidnapping.

It is the proceeds from con-soludo-tion that can explain how Soludo could pay =N=150million in bribe money to a certain stakeholder to endorse his candidacy for the governorship election, another sum of money in hundreds of millions of Naira to a key member of the former PDP national executive for the same reason. Yet Soludo claims to have been pressured into running for governor! Professor Akunyili was also pressured but she boldly, stoutly and confidently rejected all promptings, overtures and exhortations. The grand scale fraud that is con-soludo-tion only can explain the mansion acquired by Soludo off Kilburn Road in highbrow London and in choice locations across major cities in America and Western Europe along with their adorning fleets of cars and other indices of ill - gotten wealth.

It requires a less than determined scrutiny to throw up the facts, evidence and intelligence regarding the grand scale regulator - induced fraud that is con-soludo-tion. This is the reason Soludo is desperate to be governor so he can enjoy constitutional immunity. This is why his frustration at losing the election will know neither abatement nor expiration nearly a year later. His consuming hatred for Professor Akunyili stems from her principled position that lacked requisite leadership credentials. He was not a principled man, nor was he decent, humble and well brought up, especially in his all important formative years. He could not do the work of rescuing Anambra State from the near cesspit in which sinful and refuge – seeking desperados like himself had lodged the hapless State.
The Honourable Professor Akunnyili’s principled position was inspired by the awareness that the sterling credentials required of a governor: humility, accommodation of all shades of opinion, were the polar opposites of what Soludo represented and con-soludo-tion portended for the good people of Anambra. She was well aware that this vile philosophy was prebendalism par excellence. If it engendered a locust season in the entire country then it would simply sound the death – knell for ndi Anambra.

Con-soludo-tion will rob every Anambra citizen of their life’s saving and estate and consolidate all in one man’s pocket. This was the reason for her principled rejection of consolidation in Govt. House Awka. It was a forthright position borne of conviction. It was an intervention on the side of the people. No amount of falsehood from an idle, wayward and maladjusted son – in – law rendered resource – laden by the spoils of con-soludo-tion, will dissuade this forthrightness.
