Very simple case. Go to the UK embassy and report the matter. He will be given a temporary travel document which he can travel back to the UK with...of cuz he should get a new nigerian passport ( he can apply for a new resident card when he gets there). He can get his uncle imprisoned (if the uncle is presently in the UK) for forced labour since his uncle seized his personal documents and restricted his free movement. ruffp: Says who? before they can issue him/her anything,the sponsor opinion will be sought,infact a letter duly signed by him must accompany any Application base on that case. The best Chances he had was when he was in UK,he should have raised an alarm,trust me he would have been under some sort of protection (assylum) and that would have earned the uncle a Criminal record,but this guy Mumu so tay he follow the uncle come Naija like say na jazz. Solatium: He already has his residency and doesn't need any sponsor for anything. The card is only a copy that can be replaced if lost or stolen. He has his residency records on their system. He should go to the embassy. If you have a contrary opinion kindly paste the link here, else stop misleading the op. 1 Like |

If your BRP was stolen, damaged or lost outside the UK, you would face some administrative hassles! It is not possible to apply for a Biometric Residence Permit outside the UK. You will have to apply for a replacement BRP visa. This will allow you to enter the UK on one occasion only. The application process is done online and currently, cost £154. |

I don't know how best I can answer your initial questions but he left Nigeria with Italy visa, from Italy he applied for the UK visa and every other document. He has been in UK for more than three years. That's the best info I have. keepingmum: |

Sincerely appreciate everyone who took time to comment. I will advise him based on what I have read and learnt here. For those who think it's a fiction/interested in the misunderstanding, the issue is more of a family affair. More suggestions are still welcome. Control7: What visa did he apply to get into the UK, what visa did he renew whilst in the UK. How old is he and what type of Job did he do whilst in the UK Italian visas are schenghen visas and the UK isnt part of the Schenghen countries |

ruffp: Residency card is just a form of identification in case you are stopped by the police or immigration,you can not board an aircraft and travel on residency card,,it can not stand in lieu of passport. Residency card with different Years of validity,o have seen that of a year and I have seen that of 2yrs,is not ILR And can not replace ILR,the subject has a condition attached to that card/Visa,so stop confusing yourself |

ruffp: His Residency might be subjected to terms and conditions,which I am sure it will in his condition,if marriage Visa can be subjected to conditions,a sponsored work permit ALWAYS HAVE conditions attached to it get your facts right. it may interest you to know that some RED PASSPORT ACQUIRED through Parental lineage are now subjected to conditions. Gone were those day's things were automatic. |

Solatium: I think we deviated from what the OP said. He said work permit. And yes if it was a work permit it is likely the uncle processed it using his own company or a friend's company in which case the uncle can withdraw the sponsorship since he is no longer in his employment. I suspect what the uncle did was to bring him back to nigeria at the point the work permit expired in which case erased the opportunity for the guy to look for another job n enable the new job to sponsor his work permit n ensure his continued stay in the country. Since he is back in nigeria n the work permit he had is probably expired ( and the sponsors of the work permit would hv likely informed the uk govt that they are no longer sponsoring him) he cannot go back to the uk, thus he has to get a new visa based on his own merit (most likely a holiday visa or any other type inclu another sponsor for a work visa/permit). So YES he made the mistake of returning with his uncle, and he has NO WAY of fighting this. ***I don't know why my previous comment had resident permit. Perhaps the op modified his post or was simply an oversight on my part. However what i stated about a resident permit holds. Once u are a resident u have unlimited access to the country safe for voting. And as a citizen u hv same rights as a natural born. All those ur comments as regards PR is FALSE. Go n read up UK citizenship n residency. |

ruffp: Dude,There are so many things that has changed over the years,I have a female friend whose father was a student in UK in the late 60's,he had a British passport before he returned home in the 70's,got married and had all his children in nigeria.ever since he returned he has never stepped into UK again,the first daughter Saw the old passport and took it to Eleke,the passport was ceased from her and was ask to go call her father,the father turned up and the ownership was confirmed, passport renewed and details of children taken backed with DNA test right there at Eleke...... Fastforwad, Uk Passports were issued to all the children,this was in 2005/6 .then the law changed in 2008/9 that the offsprings of those children can not automatically inherit that citizenship from the parents the way those kids inherited theirs,it is either (1) they are born in the UK or (2) One of the children must be born in the UK for it to be able to cover the siblings (3) those who were born outside the UK must live a certain years in UK before they could be entitled to the passport. This Lady husband have a well paying job in Nigeria,she is also doing well business wise so there is no point living in the UK,but she was forced to leave for with the son UK somefew months ago in order to be able to secure a passport for the son born here since they have not had another child. You need to know that thing's are no longer static,rules are changing,I have seen someone with ILR forcefully deported back to Nigeria,and his family are all citizen,bro whatever you hold today is not a guarantee,just becareful and stick your ear to the ground for the changing information |
