All she has to do is provide information that proves she's the actual mother of the kids and it will be ascertained that the man falsified a death certificate which will either land him in jail outrightly or face deportation. A child can be kidnapped by their biological parent. It is not "Nigerian law", it is Australian law since those kids were taken to Australia without their mother's consent. Yes even under Nigerian law it is still a kidnap. Same thing happened to Adenuga's son. He kidnapped his own child and prevented the mother access to the child even after the court granted custody to the mother. He's facing kidnap charges currently.. Neddyogu: 2 Likes |

Oga if a court order does not restrain a biological father from access to his children, a charge of kidnapping cannot be leveled against him. Lmao, your ignorance has reached the high heavens and the angels are in complete awe of your folly. For the umpteenth time, a father has zero right whatsoever to travel abroad with his kids without the consent of the mother of the kids and vice versa It is even impossible for one parent to secure visas for the kids without the consent of the other parent. If you successfully travel out with those kids without the other parent's consent, it is a kidnap. This is the standpoint of the law and it is obtainable in every country where sane people live. FYI, a Parent (any Parent, father or Mother) without any Court order stating otherwise, is a NATURAL CUSTODIAN of their Child/ren, ab initio. That is all l said ........and that is very, very different from saying one of the parents have "sole custody" (which is a revocation of the custody rights of the other parent!). You are most likely a kid but even at that, if you cant comprehend, interpret or decipher a straight-forward, basic statement like that and you have to go-off tangent like a deranged banshee, then you and l are not on the same planet and we cant have a decent convo. Which comes first, the "kidnapping" or the "natural custodianship" of any or one of the Parent of a child? ...because one can invalidate the other! For example, can a woman take her child to school or to church on Sunday morning? Yes. Can a father too, take his child to the same places? - Yes. Can another person, say a neighbor too, do the same without permission from the parents? - No. The question then is WHY and what is the difference between the too scenario? l can be SUCCESSFULLY Charged (successfully is the key word here because anyone can make an allegation) if l am in custody of a child that is not my own, say l took him to school or even to church! - Correct. The answer lies in the "natural rights of parents" to be with their child/ren. Any parent can be with their child (if no Court Order says otherwise) ANYWHERE, without that "association/Custody" being termed an offense. That "Natural Rights" of association/custody, derives at birth and covers both parents. But the "natural right" of one parent to be with their Child CANNOT EXTINGUISH the "Natural Right" of the other Parent to also exercise their own right to be with the same child. This is WHY Consent of the other Parent is always required, if you are going to take the child away, especially outside jurisdiction, .....because you will, by doing so, deny the other Parent of their "Natural Right" to be with that child. But that still DOES NOT EXTINGUISH your own "natural rights' as a "Co-Parent" of that child because ANY PARENT has a natural right to be with their child......which is the right the parent being accused, will claim to be exercising!. Judges world over, always "balance" these three rights together, when they make decisions in cases where ONE Parent shouts "kidnap" of their child, by the other Parent. Issues like: - How long has the "accused Parent" been with the child? When last where they with the child? - Is their an 'on-going' conflict with the other Parent making the allegation? - Is there a Safety/Barring Order in-place at the moment? - When the 'accused Parent' had the child, was it with the use of force or what he taken naturally as it used to be in the past? Just because one Parent shouts 'kidnap', does not mean it is automatically and successfully a kidnap, in law. |

Even if I assume you have dealt with Judges before or are learned in law (These are outlandish assumptions that l know are not true in your own case.), so l will also assume you have heard Judges mention the phrase "extraneous circumstance". Its like saying "if you kill someone, you are AUTOMATICALLY guilty of Murder". this could be true but under "extraneous circumstances", that "Murder guilt" of an accused has been changed to "Manslaughter", Unlawful killing, "self defense", or even "death by misadventure" ..............all carrying different 'sentences' or NONE at all. Laws do have "clauses", for a reason! What l am saying is that "In Law, there is no cut-and-dry situation", it all depends on how smart your Lawyer is ....and the circumstances of the event (from a Judges point of view) |
