The Supreme Court on Tuesday dismissed the appeal by the presidential candidate of the Peoples Democratic Party (PDP) in the February 23 election, Atiku Abubakar, seeking to Inspect the central server of the Independent National Electoral Commission (INEC) for lacking in merit.

The apex court held that the request lacked merit because it was brought by Atiku after the parties had joined issues on the existence or otherwise of the server.

According to the unanimous judgment delivered by Justice Chima Nweze, the Presidential Election Petition Tribunal was in order in refusing to grant Atiku’s request at the time it was made so as not to prejudice other parties in the matter.


In addition, the apex court held that the appeal lacked merit because the appellants failed to prove how the decision of the tribunal was unfair to them.

Justice Nweze said a party can only complain of the lack of fair hearing when discretion of court was wrongly or arbitrarily used by the court, adding that in this instant case the tribunal used its discretion judicially and judiciously.

“I see no reason to depart from the decision of the lower court, the appeal is lacking in merit and is hereby dismissed,” the judge held.

Atiku lawyers are most daft in history of presidential election tribunal. A sound lawyer like Olanipekun, yes he might not win the case also but he will give a lot of research works to the judges. I followed the case from day one nothing impressed.

Lamentations of an ignoramus.

The summary of the judgement is that the courts cannot create a presidential results server for INEC and force it to be inspected,since INEC had argued in court that it did not exist.

More so ,use of server to collate election result is not known to the law or constitution,otherwise the supreme court would have compelled the lower court to do the needful.

Just tell your that there are no law that support electronic voting or e-collating of results in 2019 general election. That voting and collation of results are done manually. Refer him to nigeria electoral to see that there is no law there that support evoting or ecollating.

No INEC has Server but was not used in the elections because the 2010 Electoral Law used for 2019 elections forbid its usage.

I blame Atiku lawyers. They are thieves especially Mike Ezekhome.

They knew from Day One that this day and judgement would come but because of their selfish ambitions for more money failed to advise Atiku correctly.

The inec sever can be South Africa or China, it doesn't have to be in their office in Abuja or Lagos.

In any way, if inec wanted to have a sever they would most likely outsource the responsibility to a specialist firm that would do it for them.

If you read the report you would have realized that the headline is misleading. What the Supreme Court actually did was to refused Atiku's request based on the decision of the Court of Appeal to delay decision on the prayer of Atiku to inspect server till when final judgment is being given since all appeals related to the election have been consolidated into one.

Read the supreme court ruling.

Supreme court said since the existence of a sever is still debate with the case at the tribunal, it is hard to force inec to provide a sever it claims it does not have.

Hope that is simple enough for you.

Atiku wants inec to provide a sever it does not have for inspection.

They are not talking about inspecting the physical address of inec's head office. grin

I am not a lawyer but I believe that the court has scrutinized the petition brought before it and seen the merits and demerits if the case at hand. I also know that court judgment are based on facts and not emotions. I know that every Nigerian have turned judges overnight because of their interest in this case. I hereby submit here that based on the judgment I read on paper today, the court is in order in this landmark judgement. Because the petitioner was unable to prove how the tribunal judgment was biased.
