Minister of State, Labour and Employment and Director, Public Affairs and Spokespersons, Tinubu/Shettima Presidential Campaign Council, Festus Keyamo (SAN) on Thursday insisted that Asiwaju Bola Tinubu, presidential candidate of the ruling All Progressives Congress (APC) was not indicted or prosecuted for alleged involvement in drug trafficking in the United States.

Speaking with DAILY INDEPENDENT on the backlash that has trailed the interview he granted on Channels Television on the definition of 'forfeiture', when Tinubu forfeited the sum of $460,000 in one of the 10 accounts linked to him, Keyamo said that cannot be called a criminal forfeiture as no criminal charges were preferred against the former Lagos state governor.


He said rather than being indicted and prosecuted, the prosecutors obtained an indemnity from Tinubu to settle the matter and not to take action against them in the future.

"In the settlement agreement, they sought and obtained an indemnity from him against bringing an action against them in future for initially confiscating his money".

" In order words, they appealed to him to assure them it was the end of the matter and he would not come against them in further, which is more like a plea for the matter to be finally settled".


Also speaking on Tinubu’s forfeiture of $460,000 in one of the 10 accounts linked to him, Keyamo said that cannot be called a criminal forfeiture as no criminal charges were preferred against the former Lagos state governor.

"In law not all forfeitures are criminal; there are civil, criminal and administrative forfeitures. If there is no criminal charge, there cannot be a criminal forfeiture or indictment".

" In the case of @officialABAT, it was a civil forfeiture; there was no criminal charge against him".

No criminal charge was preferred against Tinubu simply because he was not caught in the act but the funds in his account was found to be linked to crimal proceeds (drug dealing) hence the forfeiture.


This Senior Advocate of Nonsense has been capping nonsense of recent.

What university and Law school did Keyamo attend? His certificates should be recalled.

I just wonder how a human being who wishes himself and his fellow human beings well will be supporting Tinubu, the man is an example of every bad leadership qualities, for those of his supporters claiming that Tinubu only paid his tax or some nonsense analysis to support him, just to let you know, there is something called plea bargain in justice and they use it a lot in America and it goes most times like this:

1. Accepting you committed a crime to reduce your time in prison

2. Accepting you committed a crime and also forfeit the proceeds of that crime to either reduce your time or get forgiven of the crime depending on the weight of the crime.

3. Accepting you committed a crime and help the the government with investigation by giving every information that will lead to the arrest and prosecution of other people involved in the same crime, at the same time you may also forfeit all the proceeds of that crime to the government to either reduce your time in prison or total freedom.

The truth is there is always an acceptance to the crime first before any of these can be made, I have seen where a U.S border patrol caught a Mexican lady with drugs at the border trying to enter U.S, they knew she was sent by a bigger cartel, they offered her an option right there to either go to jail or release the information of the people who sent her, she released the info and they freed her right there on the spot and let her into the country and she had to forfeit the drugs and other things they could lay their hands on that they felt were proceeds or linked with the crime.

Tinubu chose one of these options - You cannot forfeit what was not illegally gotten in the first place

It is a shame and disgrace to Nigeria for a drug convict to even be a presidential candidate.

No Matter the grammar keyamo or any urchins tries to confuse themselves with, Tinubu is a drug convict. Proceeds in his account were connected to drugs proceeds.

Nigeria must avoid the colossal worldwide disgrace.

I can't believe that a seasoned lawyer or a S.A.N can spit out this jargons!!!! Just because of what, for real See, let's start calling a spade a spade so we can really move forward!!!
If not criminally related, why should he forfeit?? The last time I checked, only criminals forfeit their money or properties!!! Just like a case of EFCC catching a Yahoo boy, won't he forfeit whatever the proceeds of his crime!!!?

Indeed, if you're a supporter of APC or a member, you lose your sense of reasoning!!!!

Keyamo is really really going on a low on this. It's better to just keep quiet on some issues rather than to please your master/Lord but look stupid in doing so. Such a shame to the Law profession in Nigeria.

I watched Keyamo on Channels last night.

Channels tv should have invited another lawyer along with Keyamo to expantiate on all the legal jargons Keyamo was spewing.

I don't want to be emotional and sentimental about his explanation because I know that law and common sense sometimes do not align.

We need lawyers to either corroborate or counter Keyamo's explanations.

For instance;

*Is it true that fine and forfeiture are not the same in law?
*Is it true that Tinubu's accounts were the ones sued but not the man Tinubu? ( This does not make sense in logic but I don't know about in legality)
*Is it true that accounts can be sued but not the person who owns the account.?
*Is it true that Tinubu was not a defendant in the case? And if so that does not indict him?

Lawyers give us answers.
